My DH went to visit his VSO about a month ago, to see about filing for SMC-S & K. He's had ED for years, plus the SMC-S ought to have been considered when they awarded him 100% for PTSD in addition to his existing 80% for other issues. I finally looked at the copy of the 21-4138 that the VSO submitted for him (I haven't been keeping up so well with things... I blame myself). Here's what the VSO wrote for him: "I am requesting consideration under any and all applicable Special Monthly Compensation Codes. In 1998 I was awarded 100% IU P&T, my wife and five children received their chapter 35 and Champva paperwork. At that time I was rated, 30% depression 20% rt ankle 20% rt femur, hip, knee w/leg length discrepancy 20% DDD Lumbar 10% left knee In the rating decision it stated that I was determined to be disabled not by my MH condition or physical conditions on their own, but when looked at together the record showed that I was disabled due to my service connected conditions, which were caused by a single event in service. My husband was recently awarded A&A at $4194 per month. My question is how do we determine what level of A&A he was given? Nowhere in the VA letter does it state how they determined the amount. He was being paid at the statuatory houseband rate with SMC K for loss of a creative organ. We also have one child in school over 18. I am having a hard time reading the rate tables as I do not understand what the "parent" means on the tables. Any help would be greatly appriecated.

In my recent award for TDIU and SMC for loss of use of creative organ.........This statement was also noted: Examination for housebound status or permanent need for regular aid and attendance showed disabilities of Copd, cervical spine and lumbar spine spondylosis restrict activities. You use a walker for ambulation. OK copd and cervical spine are Not serviced connected. Va provider and social worker both claim need for aid and attendance and in fact had VA provided home care worker while wife was down with cervical problems. VA provided c/p exam on 11/19/12.. Hi, been out of the loop for a little while. Feels good to be typing again. Here's the question/story: My DH was rated 100% for PTSD back to 2011. He already had been rated 80% for a shoulder injury and multiple burn scars, so his rating is 100% + 80%. His VSO never said anything about filing for SMC-S, and neither he nor I have been really able to hold onto the idea of filing any kind of claims (the whole process of getting rated for PTSD wrung us both out). Last friday I got another WHITE envelope.I am already 100 % with TDIU> So now I want the fastest way for the VARO to to follow the law as in FAST LETTER 09-33 and rate SMC -S , The latest were for tinnitus 10% and DEPRESSIVE DISORDER 70%.My legion rep isnt as smart as he thinks he is. (he even told me not to send signature and delivery conf. info to the va.)
