For sake of discussion....and opinions I am rated as: 100% Asthma/COPD 60% DDD w/ Left foot drop 30% cataract with/ pigmentary gloucoma and optic nerve damage 10% sinusitis 10% rhinitis 10% Knee limitation of motion 10% Knee lateral instability 10% hemorrhoids 10% tinnitis 0% Hearing 0% eppidmittis I have A&A SMC L 1/2 ( because of a 100% rating and seperate 50% rating) I have one K award loss of use of left foot Prior to award of 100% I had TDIU for DDD. I recently sent a letter to my DAV rep in New Orleans requesting an expedited hearing with the DRO on my increase for Aid and Attendance to a higher level. On Jan 13th 2011 they sent me a letter stating they received my request and stated a hearing is not necessary for them to process my appeal further sending me a form with 4 different choices for which hearing I want. I was under the impression when I initially requested a hearing by the DRO back in October 2010 that this officer would review all the facts of my case along with any new info I may have sent in and render a decision before it goes to the Appeal part of the case. Is there a table online some where that tells you what each smc rate pays for. For example for SMC due to house bound what rate are you paid at. And as for the smc rates... does that include you compensation funds and you smc or is that in addition to your percentage. just trying to under stand smc and know where I can get more info about it. thnx

What do you make of this? I put in a claim for IU, frozen shoulder sec to DMII, flat feet secondary to service records in sep 2008. Sent in supporting documentation w/ claim. sent in claim thru DAV. Had a mental health exam in july 2009, as well as a physical C&P Exam, & an eye exam in July 2009. Never was examined for frozen shoulders (bilateral). At the time I i'd had a rating of about 84%, 20% DMII, 30% PTSD, and the rest for conditions secondary to diabetes such as bilateral neuropathies, HTN, etc. & SMC-K. Had had all this for about 7 years. In November 2009 I was rated 70% PTSD, given IU based on the 70% PTSD w/ SMC-S. With a future exam in …

I was awarded 100% service connected disability last November. Someone mentioned that I might be able to be reimbursed for medical treatment, hospital, prescriptions, etc., not prescribed by a VA Medical Facility. I've been going to private doctors, etc., and even getting prescriptions privately. I also am prescribed liquid formula (can't eat or drink any food by mouth)...I use a stomach tube for feeding. I know that I can now go to VA and get things paid for. Just want to know if I can get reimbursed for stuff from private facilities. Does anyone know if this is possible reimbursement from the VA? If a vet is housebound does that make him/her eligible for Fee Base? I am wondering since physical access to my local VAMC is horrible for me. It means a long drive and then a ride on a shuttle bus often in miserable weather.

I had applied for IU, which was denied because it was "moot" when I was awarded 100%. However, Bradley vs Peake clearly shows that it is NOT moot, because IU plus 100% clearly qualifes the Veteran for housebound. (SMC S, I think). Is this CUE?

Went to c and p on Monday. Lasted around an hour or more, examiner was quite nice and well informed I could tell he read my file all the way back to the first page. So that went pretty well, then he tells me they have to schedule me for a memory test that takes anywhere from 2 - 6 hours. Has anybody had this memory test. I am so freaked out about leaving the house and being stuck somewhere for a couple of hours, I'm in a panic. Anyone with any experience with this your input would be appreciated.

Went to Voc-Rehab yesterday. They denied my request for Voc-Rehab because, "After carefully reviewing the evidence, I find that you already have the education and training to qualify for a suitable job. You do not need Vocational Rehabilitation and Employment services at this time". What evidence did VA consider? "In making this decision, I considered the following evidence: The number and severity of your disabilities." Any Opinions? Thank you, David

Hi all, The DAV filed a claim for me for loss of right testicle due to agent orange exposure. I knew it wouldn't fly but they had gone ahead anyway. Total waste of my time. They sure are quick to jump on issues before a good analysis is performed. This is one of the reasons I fired them! However, I do have evidence and will change the claim during my appeal. SMC I was just wondering if my husband filed to add his heart condition in 2002 and also filed for SMC how would that affect any retro pay. At the time he filed he was gravely ill. He was rated 100% SC PTSD and he then filed his heart condition along with SMC in 2002. Scenario: Had he been granted SC for his heart and for the sake of argument he was rated 60% for the condition how would the SMC benefits be applied under Bradley vs Peake (do not know if this is cited correctly).
