This is a very unusual story-I am contacting his attorney because I dont know what kind of settlement he got- maybe he appealed the 1151 denial. We had a widow here about a year ago, in the same predicament. She was trying to file for wrongful death of her husband but VA said the doctor was not a VA employee, but a private contractor-working for the VA. I filed a letter of complaint to BVAMC after suffering a heart attack and residual damage due to their (BVAMC) not addressing the diagnosis and complaint (non treament of a known condition for 3 years ). Instead of filing a complaint claiming an amount certain the VSO told me I could write a letter of complaint to the hospital but not to enter an amount for damages ! Of course they never replied to my letter.And I filed an 1151 within the 2years of my heart attack. It was denied after 4 years in the merry go round called adjudication. ptsd New To Habit, But Need Help And Suggestions
I have been researching this for sometime now and haven't even found anything close to this type of lawsuit online. I already have a lawyer so that part is already taken care of. I suffer from 30% PTSD at this time. I served in OIF1. I have been seeing a physiologist at the VA for 5 years every week on Tuesday. I need an FTCA attorney. I have a Wyoming attorney willing to stand in as the Wyoming attorney for filing in the U S District Court for the Wyoming District. Need help so I'm going to shorten my story....I have a service connected disability which prevents me from working that the VA did not inform me of and treated me for a different condition any other doctor would have seen that I had an actual medical condition and treated it instead of assuming it's something else...I went to vocational rehab and it was found my disability prevents me from working is that enough to win a tort claim on the fact that the VA found me unemployable?

Valid Complaint?
Hi Im new here. Thanks for having me. I was set up with the VAMC Apr 14. First time since I left the Army in 84 that I had any real heal care. Back problem from service still is an issue, first time out, brought to the attention of my PCP. She gave me a tube of "stuff" to rub on my back, and that's all. Fast forward, 6 months, notified her on that next visit that the back problem is still there. She didn't say anything, no physical contact, no exam nada. Next thing I know, appointment for Phys Therapy comes in the mail so off I go. PT gives me the going over, tells me that hyperextension of my back will help me. OK, Im game. Have been fighting the VA for 10 years now and now have a hearing comming up next monh with a judge. can anyone tell me what to expect and how i should prepare for this? A reporter here in NY is preparing a story on why the malpractice payouts regarding VA FTCA settlements have risen so much over the past few years. He was specifically interested in FTCA cases that occurred due to improper health care in New York state VAMCs. The picture is far bigger than that.......
