Preparing For Death From Metastases Of Melanoma
Long story made short. I am SC for skin cancer. In 2012 a biopsy by va was benign, another in 2013 wae benign. The skin spot kept getting larger. I requested an outside consult and a biopsy then was malignant desmoplastic melanoma and the pathologist recommended immediate surgery to remove it. The VA went back and redid the old slides and the new report was changed to agree with the outside consult doctor.The VA waited for over a month to remove it and also did a lumpectomy (sp) to remove what they call sentinel nodes. 1151 Dic Award With Imo From Dr. Bash
I posted this due to a different topic here today but this is a good example of how a DIC claim under 1151 can succeed: Dr. Bash's IMO is referenced in the decision. This widow, like me did not originally file the 1151 claim, her husband did like my husband did, and we both had to continue the 1151 claim after their deaths. Her DIC and accrued claim was filed within one year of the veteran's death so she was eligible for his accrued 1151 comp and also the 1151 DIC. A great case but it goes to show how difficult VA can make things for widows.

Need help so I'm going to shorten my story....I have a service connected disability which prevents me from working that the VA did not inform me of and treated me for a different condition any other doctor would have seen that I had an actual medical condition and treated it instead of assuming it's something else...I went to vocational rehab and it was found my disability prevents me from working is that enough to win a tort claim on the fact that the VA found me unemployable?

I needed to bump this up ............... An IMO for this type of claim needs to isolate and specifically describe the VA negligence in detail with references to specific medical tests, and entries in the VA medical record that would lend to a full medical rationale supporting either a FTCA or 1151 claim. Gauging A Tort Claim
Good Morning! I'm a newbie but have used this site many times for important information. I would like opionions on a potential 1151 and FTCA claim I'm thinking of doing. I say thinking, because not sure if it applies but also feeling a little bit werid thinking of doing this.
