Survivors- a Must read
If you are new to hadit and have DIC questions it would help us tremendously if you can answer the following questions right away in your first post. What was the Primary Cause of Death (# 1) as listed on your spouse’s death certificate? What,if anything, was listed as a contributing cause under # 2? Was an autopsy done and if so do you have a complete copy of it? It can be obtained through the Medical Examiner’s office in your locale. What was the deceased veteran service connected for in his/her lifetime? Did they have a claim pending at death and if so what for? If they died from anything on the Agent Orange Presumptive list ( availa…

My daughter owes the VA education department 2500. She has made 50.00 payments per VA for 10 months down to 2055. She started school July 5 2023. VA never said they would hold her Chapter 35 benefit. She has not been paid for 2 months. She just got a letter today from the VA stating they are holding her benefits until debt has been paid. No one said anything about this. She just certified her attendance yesterday. Need help, ty

War Veteran Spouses Wrongly Denied Help
WASHINGTON: Surviving spouses of war veterans have been wrongfully denied up to millions of dollars in government benefits over the past 12 years due to computer glitches that often resulted in money being seized from the elderly survivors' bank accounts. The Veterans Affairs Department said Saturday it wasn't fully aware of the problem. It pledged to work quickly to give back the pension and disability checks — ranging from $100 to more than $2,500 — that hundreds of thousands of widows or widowers should have received during the month of their spouse's death. "This problem must be fixed," said VA Secretary James Peake. The department indicated in an "action plan" …

Va Glitch Causes Dic Widow More Grief.
Dear Honorable Senator Akaka, I am concerned about my wife's DIC payments after I die. I am a former resident of Hawaii. I write you today as a combat wounded Vietnam veteran, recovering from cancer treatments and surgery. While putting my affairs in order, I came across a veterans website posting which brings me to you today. I read this veteran's widow's posting on Christmas, . ...I have come to Hadit this time with a broken heart. My kind and sweet husband of 27 years died last Friday. ... Saturday, January 3rd, the widow wrote, ...I was glad to see that VA had deposited his payment as usual for the month of his death. Auto payments were due to po…

How Many Times Does The Va Require Widows And Orphans To Beg
The VA website explains that some widows did not get paid because the VA didn’t always know they had a surviving spouse. http://www.vba.va.gov/survivorsbenefit.htm VA to Provide Payments to Eligible Surviving Spouses “Because VA does not always know if a veteran is survived by a spouse, some surviving spouses have not received the month-of-death benefit to which they are entitled.” However, those who have read the news know about the “computer glitch.” The explanation of the computer glitch is that the VA never updated its automated computer systems, which sends out checks and notification letters. As a result, spouses were either denied the final month of …

ptsd Accrued Benefits
some widows at other sites have been urged to join us here- one widow seems to have misinterpreted the Accrued benefits regs- Simply put- if a veteran has a pending claim at time of death-the surviving spouse can claim 'accrued ' benefits via the 21-526. Accrued benefits can be paid to the surviving spouse or in equal portions to the next of kin. However NO accrued benefits are paid to anyone unless formal application has been made within one year after death. Even if the 534 is never filed , any next of kin can apply for accrued if they are eligible. The important thing on accrued benefits is that the claim MUST have been pending at time of death. Pen…

ptsd Cause Of Veterans Death
Hi, I have been reading the forums for a while and thought I would post a question concerning DIC. My husband a Combat Wounded VietNam Vet, passed away in January 2004. When he passed away he was rated 90% Disabled and had a claim in for TDIU (which he had filed in March 2003). In March 2004 I received the decision which denied his TDIU. I as the widow filed a new claim for the TDIU and Cause of Veterans Death in March 2004. Needless to say it was denied and I appealed it. I had a hearing before a BVA Judge in Washington DC in March 2008. In August 2008 I was awarded the TDIU claim with back pay to March 2003. and the Cause of Veterans death was remanded to se…
