Got a call today from my attorney's office, it appears that the VA has increased my compensation from 10% to 20% without any exams just by reviewing my medical records. It's retro active to 9/2003. This is a victory in a small battle but I m going on to win the war. The rater that rated my claim in 2008 overlooked that I had a diagnosis of scoliosis in 9/2003 and therefore my rating should have been 20% not 10%. I ll get excited when I see the money in the bank. According to the VA Coach, I will be scheduled for several more C&P exams in the very near future. After reading the rating formula for diseases and injuries of the Spine, scoliosis appears to be r…

ptsd ? about SMC-S and Retro payment
First, let me say thank you for a great and knowledge on this site is overwhelming. I found this site recently and have been bouncing around here. That's when I found SMC-S. I'm rated 100% TDIU for PTSD effective Dec 2003 as stated in my decision letter. I was also rated 60% for my back at the same time but SMC was never considered. This leads me to ask 2 questions from the members here: 1. How did you apply for your retro SMC? 2. Has anyone received a retro payment based on a decision prior to 2008? Thanks for the help & info.

"Denied because disability not clinically diagnosed"
I filed a claim for GERD in April of this year. I had a C&P last month. I loaded medical records from service of an upper GI that was done and the reason it was ordered according to the medical form filled out by the doctor was "DYSPHAGIA HX GERD" . I just received my denial letter stating "the medical evidence of record fails to show that this disability has been clinically diagnosed". I don't know what more I could have sent to them to prove this was diagnosed in service? I have been treated by the VA since I got out of the military in 2009 with Prilosec daily, and still have some days when the reflux is terrible. I sleep with 5 pillows under me so that my head…

First and foremost I want to say thank you to all the members here on hadit. This my first post, however I have been coming here for help and support the past nine months. My initial claim was submitted 25 April 2011 (I know that’s child’s play compared to many here on hadit), which consisted of the following: PTSD, TBI, titintus, and depression. Here's my situation, I was recently rated 30% for tension and contraction headaches "effective date" December 2013, however I was already rated 0% August 2002 so here's my question, should I NOD for the 2002 as my Earlier Effective Date or is the 2013 correct?

**finally Dro Hearing Scheduled! What To Expect?**
Filed for an increase on my 2 claims, one is at 10% and other @ 0%, back in July of 2007.. After the original denial I filed the appeal and after over year finally get my DRO hearing Dec 15th in Cleveland.. Can't wait to prove my what should of been a open and shut case, according to their rating system.. Any tips or better yet anyone who has dealt with Cleveland.. John T

Hello: :D In January 2006 I wrote a post that detailed my scare with the many cases of the Lipoma disorder I had found in Veterans medical records. I posted my scary experience below this post so please read before you go on. I must say that it's been almost 4 years later and I've found some interesting evidence that should be looked at more carefully. So ebenis went to prep for notification then back to gathering of evidance. I was sent the big brown envelope that stated I was rated 0% for depression how ever today I had my C&P exam for the depression? What exactly doesthis mean? Can my rating go up because it sure cant go down? The exam sounded like most peoples story of a 10 minute asking of simple questions...?
