Entitlement - Veterans Compensation Benefits Claims
Once you know you are eligible for Veterans Disability Compensation, the question then becomes are you entitled to it by law. This is where to post those questions. it's OK, if you are feeling confused this is not at all unusual it can be a very confusing system. If you were injured in service and have a question about whether you are entitled to file a claim, post it here. Law 38C.F.R.3.4 (a)

Survivors benefits?
My father in law, "Marine Corps Gunny" passed away suddenly Friday and we are really hurting as a family. He was 70% disabled but also retired. I'm not sure how or if that factors in with disability pay/retirement pay. My question is What does his wife and daughters need to do as far as VA disability and retirement is concerned? You all are such a blessing!

I need help with what to do with my child's education costs
Hi, Regarding education benefits retroactive for my child. (retroactive 100% P&T after she had filled out all the VA education benefits forms with the va during her schooling before my appeal awards for 100% P&T). I am trying to figure out how to state my problem and not mess it up in explanation. Those that have had experience with this and navigated successfully I hope can figure it out. I was only at 50% VA disability (I was filing disagreements and permanently disabled, with SSDI, but not the 100% benefits for dependents) while my daughter went to school, she was born 1992. She graduated high school 2010. Went to community college…

3M earplug lawsuit
Looks like this fight is moving forward. I received a letter from the attorney three days ago and looks like I am a part of the 29,000 cases being called to the active docket. I am wondering if anyone has done a deposition? What should I expect if I am called on? I have never done this before, so I am not sure what will happen.

Claims question
Hello all. Been fighting a back claim for last 3 years. Every time, send in new information, get new C&P exams, get different decisions ( but all not service connected), it has been renamed a different disability 5 times. Have recently been diagnosed with Ehlers Danlos. Has anyone ever had experience with this? Yes, it is genetic, but no, I was not aware that I had it. aA little bendy, yup, but thought some people were just like that. definitely a good reason why hurt my back way I did years ago, and body ended up way it is now. Spinal fusion last July. Don’t have funds for lawyer, or the crazy amounts for private nexus letter.

Received P&T Unemployability. Should I appeal 70% Rating?
Hi, Last week, I was awarded P&T TDIU for a claim that was previously awarded 70% mental health disability rating. Should I now appeal the 70% mental health rating? The word "total" is difference between a 70% and 100% mental health rating, as I read the information. Is P&T unemployable possibly considered as a 100% disability rating? Thanks

How to stop an Apportionment
Hi there, I need help! As of 2018, my ex-wife filed for an apportionment and surprisingly got awarded it. I tried to appeal it but still got denied. I don't even know HOW she managed that considering the child support she was already receiving from me through our lovely California court system. She was married, had a job and multiple side jobs so she was not going through hardship whatsoever. Fast forward 3 years later, she is still receiving it. We have 50/50 custody and everything financially/medically is split. I've asked her to stop the apportionment but then Covid hit and she was jobless by choice. She would turn down jobs because she wouldn't make more than h…

30 Years to file claim, is this possible to win?
Disproving a discharge for a physical disability existing prior to entry determined by a medical board. Facts. Entered the United States Marine Corps November 7th 1990, discharge date May 20th 1991 for a total of 6 months 14 days. In Wagner v. Principi, 370 F.3d 1089 (Fed. Cir. 2004), the United States Court of Appeals for the Federal Circuit (Federal Circuit) found that, when no preexisting condition is noted upon entry into service, the Veteran is presumed to have been sound upon entry and then the burden falls on the government to rebut the presumption of soundness. The Federal Circuit held in Wagner that the correct standard for reb…

COLA increase for 2022
The Social Security cost of living inflation adjustment was just announced. For 2022 benefits will be adjusted 5.9%, which is the highest adjustment in many years. VA compensation benefits, by law, will also receive the same adjustment. Increases will start to show up in our January deposits. Inflation is a nasty thing but this will help ease the pain.
