100% ptsd, rated SMC
If you actually receive regular treatment for ptsd, Clemons Vs Shinseki 2009, is all that is needed to advance your claim. If it is a documented fact of record, Clemons requires a substantially complete adjudication. Missed evidence in your record fails Clemons and requires the VA to redress. Clemons put a higher requirement on the adjudicator. They didn't get it at first in my case, but I just pointed to a material fact, claimed great weight for my doctors statements, and presented Clemons. When from 50 to SMC, over six years. I hope this helps, the VA, DOJ, and our VSO's are way behind the curve on this. The decision came from the CCVA.

New VA Regulations with Sleep Apnea Being Secondary to PTSD
I'm rated since 2008 at 50% for PTSD. Also, 10% for tinnitus. I was just diagnosed at the VA with sleep apnea and prescribed a CPAP. I was wanting to file for sleep apnea secondary to PTSD. I have the diagnoses but need to find a doctor to write a nexus letter. The pulmonologist and my PCP said that they could not write the nexus so thinking of using something like valor for vets and would like opinions using a service like that. My second question is I know the VA is changing the percentages from 50% if you're prescribed a CPAP to 0%. I don't know exactly when the changes go into effect but when they do and if I do file will they go by file date or dec…

I have been reading hadit.com as a "guest" for many months now. I think the advice given out by Tbird and others has been excellent. My claim for PTSD,Aggravtion of "bi-polar condition", heart, etc has been in Seattl just over a year now. I k now this not bad as many vets claims have taken considerably longer. I called the 800 # last week and the person said my claim has been up to "the review panel twice". I can't understand the problem / situation. ptsd Central Sleep Apnea
Need to NOD, COSA, but more importantly, CENTRAL sleep apnea, due to Secondary PTSD. PTSD causes Brain stem changes. ANYone know how anyone got this Service Connected if not found before he retired? His COSA led to sleep study, and that is how it was picked up. BUT NOT THE Sleep study done by the VA, but the outside sleep study!!! Interesting. Thanks, Brenda

Not sure where to begin...I've just completed my second deployment to Iraq and during the process of Reverse SRP at Ft. Bragg was pulled for WTU (I never was medavac), and then later transferred to CBHCO-AL. I have had three operations - Bilateral Carpel Tunnel Release's, Right Ulnar Nerve Transposition. Also, I have chronic lower/mid back & neck pain (no operations performed at this time for these later injuries) and numbness & tingling to my lower extremities. PTSD Exacerbation
A bit of a convoluted question: If a veteran's PTSD was not initially caused by combat, but rather, for example, decades of mental and emotional abuse beginning in childhood, and that veteran also lived with Autism Spectrum Disorder, and the stresses of military service made this PTSD much worse, would that veteran be able to claim his PTSD as secondarily Service Connected?
