Quest To Prove Tbi
Like many of you I spend way to much time thinking about this stuff but I decided to keep an updated logg of my progress and what better place to keep it than here. Back in 98 while in basic training I was knocked unconcious when a fellow recruit hit me in the head from behind by swinging butt stock of his m16 like a batt. I was unconcious for nine hours and awakened at 3 am when I was found in the woods. The drill sgts swept it under the rug and was simply labeled as a training accident. Fast forward 14 years and I have many problems. Sever loss of hearing Loss of balance Slurred speech Numbness in left facial area with drooling Decreased memory It wa…

He initially received a rating for a knee injury he recived from and explosion in Iraq but several months later after passing out (I thought he had a stroke!)at our dinner table and being hospitalized for over a week, and numerours testing he was diagnosed with "neurocardiosyncope". Told him nothing he can really do just make sure he eats 3 meals a day , drinks a lot of gatorade, avoid stress, caffeine, and plenty of rest. Then to make a long story short we ended up at the Va and…

Changes to TBI Ratings
CHANGE TO TBI RATING SUPPLEMENTARY INFORMATION: This document proposes to amend VA adjudication regulations (38 CFR Part 3) by revising 38 CFR 3.310 to add five diagnosable illnesses as secondary conditions which shall be held to be the proximate result of service-connected TBI. Scientific Bases for This Rulemaking In the National Academy of Science IOM Report, Gulf War and Health Volume 7: Long-Term Consequences of Traumatic Brain Injury, the IOM concluded there was “sufficient evidence of a causal relationship” (the IOM's highest evidentiary standard) between moderate or severe levels of TBI and diagnosed unprovoked seizures. The IOM found “suffic…

TBI vet here, I think a miracle happened...
I've been a reader here for years, rarely talk, took advice, filed my claim, was denied, appealed, you know the drill. I'll try to give the basics of my story from hell. During the Gulf War, stateside, I had an accident while we were loading aircraft and I was knocked unconscious. Being the gentlemen that they were, my buddies carried me to the side and finished loading the aircraft. Afterwards they laid me on the couch in the break room and I came to sometime later. The accident wasn't documented, But I did start showing up at the base hospital complaining of nausea, vomiting, headaches and sleep problems. One doctor was so irritated at my complaints that she …

ptsd Mild Tbi Possible
For almost a year, I have been rated 100 percent schedular (temporary not permanent/total) for anxiety/depression. My "long-suffering" road to the rating began about 15 years ago on active-duty when I began complaining about bouts of lethargy, lack of concentration, confusion, muddled thinking, difficulty prioritizing, difficulty accomplishing tasks or a general lack of or stunting of what I have come to know as "executive functioning" or some similar term. I began re-reading sentences and paragraphs several times to get the meaning. Writing was and still is a chore, even though I have written well on many occasions, all the while thinking no one but me knows how much eff…

Tbi C&p Yesterday
Just had my C&P for TBI due to MVA 20 years ago. The examiner stated she read my c-file, and thanked me for putting together such a "great" claims package. She asked a few questions about the accident itself, memory, headaches, ect. Then checked my reflexes, vision, and asked about my sense of smell. On my way out the door, she stated that I was SC for TBI, and the RO willl decide my %. All totaled the exam was 7:36. Does this sound right?

ptsd Reconsideration For Tbi
I have been seeing the TBI clinic at my va hospital for a few years now. I had previously put in a claim for mild TBI. I had multiple contact with blasts in Iraq. 2 Combat tours with 1st AD Infantry. I also have a PTSD rating of 50% and Tinnitus at 10%, total 60%. I have been unemployed since 2008 and I went through voc rehab and they found me infeasable for work, untrainable, not expected to get gainful employment. I have gone through Neuropsych testing and here is the diagnosis from that testing. I am hoping this will help me get atleast 10% so I can get TDIU. I have already put in a claim for increase on my PTSD rating, mild TBI and TDIU all at the same time. Just did thi…

TBI being SC is a judgement call...
I had called the White House hotline due to the CUE and equitable relief in my case not being handled. This resulted in me receiving a phone call from a resolution team supervisor from my RO. He stated what he needed for my claim and I pointed out where each of these items were in my file. They reopened my claim but didn't finish it. I called the WH hotline back and received another call from the same RO sup. We went over every document and I even emailed him my entire form 9 package. He verified receiving them. He wasn't familiar with the reg for epilepsy secondary to TBI so I emailed him a copy of that, he verified receiving and we went over it. Given…

Tbi Va Low Ball Help
I am rated by the VA for TBI at 40%. I have had a neuro-psych exam and the findings fit the 70% criteria. The VA rated me lower because of a finding of a learning disability referenced in my childhood doctors files. Yes this is what they used to give me a lower rating. I guess it amounts to a preexisting condition. I filled a NOD stating and referring to the exam. I believe the time as passed to file another NOD. I should have asked for help earlier but it is what it is. Is there anything I can do? Possible have another exam. Also the neuro exam that I refer to was privately administered and submitted by me with my claim. The VA never sent me to have an exam ot…

Effective Date?
Good evening to all after finally being awarded service connection with residuals of a TBI at the BVA on Jan. 13, 2023. Just waiting on the RO to implement, I was reading over the BVA decision and wanted to know if this should go back to my original claim date in 2009? I was originally denied due to them saying no records of an injury or in service event occurred. Then I’d reopened this claim in July of 2016: “Based on the evidence of record, the Board finds that service connection for residuals of a TBI is warranted.First, the Board finds an in service event occurred as the Veteran’s STRs contain a diagnosis of TBI.” Also the benefit of the doubt was ruled in m…
