when the judge awards NEW SC THAT I DIDNT ASK FOR?
WHAT KIND OF LAWS FOLLOW WHEN THE JUDGE GRANTS A NEW SERVICE CONNECTION THAT WAS NOT ON APPEAL BUT IT WAS FOUND WITHIN THE RECORD. ? LIKE DO I STILL HAVE RIGHT OF APPEAL ?

Effective date
I am 100% P&T for my back and hips Since November 2017 I appeal a claim for Anxiety back in 2015 I received the DRO decision from the records department, And it shows that my NOD from 2015 was granted that Day awarded me 100 percent for anxiety/depression, but I’m still Waiting for the reading desition. Claim closed as of Aug 1
So, long story short.. my husband filed an Intent to File in September of 2015. He spent a year collecting medical records and everything he needed to submit his PTSD claim. He finally sent his claim in in September of 2016. He was finally awarded 70% disability in October of 2017, and with that award, he was backdated from September of 2016, when the claim was filed. Our thoughts were, he should have been awarded backdated pay to September of 2015 (when the Intent to File was received) so he sent in an appeal on the effective date. We converted to RAMP mid-March and have anxiously been awaiting the decision which should have been a no-brainer to me since the VA has…

BVA Decision on 2009 Claim in the Mail
Greetings Update! Received notification on Ebenefits and Vets.gov that a BVA decision was made on one of my 2009 claims...the letter is in the mail. That claim was denied. Five other claims were sent back to the VA for further development...this is the third time. My docket is 11-12-911. I really don't know what to say...must be patience until the end. I have never felt I had my late husbands complete medical records. I want to see things like why did his Simvastatin quit showing up on his medication list, the instructions, settings and how many hours to use his CPAP, why shouldn't he take benzo's and then he was. I asked for every page, every note, etc.. C file does not have any of his medical records in it. So, my question is, if I feel there is more information after many requests, should I use FOIA to ask for them? Thank you for your time. NO PRE SERVICE PROBLEMS... THEN ENLISTMENT EXAM PASSES WITHOUT A PROBLEM..... THEN IN SERVICE PROBLEM..... THAT IN ITSELF CREATES A NEXUS.... DONT BE FOOLED THAT IT DOESNT.... BVA DECIDED TODAY.. I HAVE A QUESTION
OK SO I HAD LIKE 5 ISSUES ON APPEAL AT THE BOARD IN D.C.. INCREASE RADIC BILAT EFFECTIVE DATE RADIC BILAT EFFECTIVE DATE OF LUMBAR INCREASE FROM 10 TO 40 SERVICE CONNECTION FOR BILAT HIPS... DRO Hearing Aug. 6 in WACO, need advice
Hello all, A few years back I posted a couple stories regarding the VA losing my claims from 2007 to 2012. (Awarded 90% on May 2016 for claim filed July 2014, NOD Filed May 2017 for EED of 12/04/2007 (Date of Discharge) First claim filed Nov. 1, 2017. VA Requested my STR on Nov. 19, 2007). It's been a very long road. TO summarize, through the VARO and my VSO, we discovered that not only are my claims missing, but ALL RECORDS from my C-File from 2007-2012, even records from my treatment at the Dallas and Fort Worth VAMC during the time period in question. SO ,,, ACCORDING TO MULTIPLE VSO'S AT THE BVA LEVEL ARE UNDER THE IMPRESSION THAT THE DELUCA ARGUMENT OF LOOKING TOWARD THE MEDICAL EVALUATION FOR FUNCTIONAL LOSS DOES NOT APPLY TO CLAIMS THAT ARE AWARDED WITH ORIGINAL GRANT OF SERVICE CONNECTION RATING CRITERIA... LIKE WHAT??????? ACCORDING TO THEM THE APPEALS MANAGEMENT CENTER AT THE BOARD OF VETERANS APPEALS IS NOT LOOKING FOR DELUCA IF YOUR AWARD IS THE FIRST AWARD OF SERVICE CONNECTION. I was given a rating before all my tests were completed
Hello everybody, I was awarded a 50% back in December 2016, but I had one more test to complete to determine whether or not I have sleep apnea. My sleep study test was scheduled for January 2017 and it came back positive for OSA, therefore the VA gave me a CPAP machine. I claimed it secondary to gerd which is rated at 0%. I sent in my NOD on march 20th and 7 months later I have not received any updates. Should this appeal be in my favor? Edit: Forgot to mention I made the appeal with the DRO in Houston, TX

Ramp
I selected The higher level review lane with a informal conference April 5. I checked Ebenefits yesterday and it says status: Pending Decision Approval. I'm happy that they are working on my Appeal but I'm confused how there has been a decision made and neither me or my lawyer received a call from The DRO. Has anyone else experienced this situation.. I'm not sure what to think.
