A Brief Overview Of The Ftca
A Brief Overview of the FTCA Malpractice and medical negligence can happen at any top notch private hospital as well as within the VA health care system. VA heath care is most often as adequate and proper as health care found anywhere in the world. But medical errors can happen. Any medical error, which could be an omission of a proper medical act as well as a documented prime facie act of negligence ,and which is not corrected immediately by the VA ,could result in additional disability and even death. The Veteran who was set for surgery a few years ago for removal of a gangerous leg, woke up after his VA surgery to find the good leg had been removed by VA inste…

ptsd New To Habit, But Need Help And Suggestions
I have been researching this for sometime now and haven't even found anything close to this type of lawsuit online. I already have a lawyer so that part is already taken care of. I suffer from 30% PTSD at this time. I served in OIF1. I have been seeing a physiologist at the VA for 5 years every week on Tuesday. I have been working forever on trying to figure out a better way to live with my PTSD. I work as a contractor in my everyday life supporting my family and a nice chunk of bills. One day I get a call from a lady telling me that she wants some work done on her house and like the business man I am I get right on it, through the talks and all I get the job. Shortly aft…

Two Weeks Before Statute Runs Out
I was doing a Google search on filing a form 95 and came upon this: Standard Form 95 - hadit.com Veterans Forum Jun 18, 2007 ... He wrote to me constantly, and called me about his case but I had to keep reminding him to send in the SF 95 that I had worded for him. ... www.hadit.com/forums/index.php?showtopic=11087 - 61k - Cached - Similar pages It seems that I was discussing this subject with Berta over a year ago. I don't recall. I was reminded that the statute is about to run out and I am not sure if there was anything that was told to me that I need to do. Tomorrow I am meeting with an attorney who's office has a plan or a program to help veterans. He is no…

Tort Claim Vs. St. Petersburg Va/tampa Va,fla.
Welll, just got off the phone w/lawyer in Austin, Tx. Michael Archuleta,J.D,M.D.,MBA(Archuleta,Alsaffar & Higginbotham) and he received the denial letter. They(VA) state "that although i was awarded 30% disability by the Va in a NSC Pension Claim for the injuries, I should feel lucky because if they made an award it would have offset my "Pension", for years". HEHEHE.noo kiddin!! Now, the lawyer wants too crank it up a notch. Federal papers will be filed in court, and were rollin, rollin rollin. Now, the 1151 papers are being filed, as well. (I think) Forgot to ask him about that.. Keep ya posted, William Can I get the copies of the Med. review of the outside VI…

Ftca, 1151's And The Dept. Of Veteran Affairs
Hey gang...long time no visit. I just want to share some helpful info with those of you, who truly feel that you were told that Statute of Limitations (SOL's) are a pre-requisite to filing a suit against the United States (in particular, your favorite agency, and mine...the DVA!). I am using my case as an example, however am not disclosing any sort of personal information. It's LENGTHY, yes, but very informative, and worth the time to read. I wrote this, to an FTCA attorney, so it may start off weird, but it was because of the formatting of the sites' web page. BTW, he refused it!? So sit back, relax, and do your due diligence. BTW...I do welcome any comm…

Sexual Misconduct By Va Psychologist
I am curious if anyone can answer the question, does the VA have a Policy or Regulation which prohibits psychologists from having a relationship with their patients after they are released from the hospital?? Also, I'm curious if it matters if sex makes any difference. If there is such a policy or Reg, I'd appreciate a reference so I can look it up. I want to file a tort against VA for sexual misconduct but think the intentional tort exception would preclude me from proceeding. It is my understanding that State laws can not be applied to the US Government so I can't use that for the tort. If I can show that this psychologist was in violation of one or more policies…

Looking For A Ftca Sample Complaint Or Template
My husband and I are 1) looking for a lawyer to handle a FTCA suit, but in the meantime don't want to lose our six month deadline (after the denied Admin. process) and have to file the initial paperwork ourselves. :D Does anyone have a sample or template complaint that can be used as a guide? I heard that a hadit member (Berta?) had a successful filing; is that complaint or lawsuit available online to give us an idea of what the format needs to cover for the fed court? Any assistance given is greatly appreciated. Thanx and blessings all! B) AFWife

Perfected Ftca
I filed a letter of complaint to BVAMC after suffering a heart attack and residual damage due to their (BVAMC) not addressing the diagnosis and complaint (non treament of a known condition for 3 years ). Instead of filing a complaint claiming an amount certain the VSO told me I could write a letter of complaint to the hospital but not to enter an amount for damages ! Of course they never replied to my letter. And I filed an 1151 within the 2years of my heart attack. It was denied after 4 years in the merry go round called adjudication. But strangely enough they awarded a 100% rating for heart shortly after learning where I was going with my complaint.. I did not even su…

1151 Or Ftca
I had an incisional right flank hernia repair (01-14-09) as a result of a kidney removal which is service connected. The surgery has resulted in a new hernia in the new incision. As a result of this,I have lost my job, I am suffering multiple medical problems including depression, lower back problems, walking with the aid of a cane, digestive problems, and constant pain at the surgery site. First, the doctor claims that my surgery is not service connected, yet I am rated at 30% for the kidney removal. Second, the doctor states there is nothing wrong with me and he has done the best he can do. Third, he states the difficulties I am having are a result of excessive weight g…
