Interesting Case On Effective Date For Accrued Benefits
There is an interesting case here: http://search.uscourts.cavc.gov/isysquery/32119468-1bd3-472d-8be0-cdab3d32e510/29/doc/ One interesting aspect is that the veteran died from ischemic cardiomyopathy and valvular heart disease while he was appealing the denial of an increase in rating for his valvular heart disease (which had been rated as noncompensable). Another interesting aspect is that the widow was initially denied DIC, though the veteran died as the result of a noncompensable SC condition in December 1995. (You would think dying would surely put the the condition into the realm of being a compensable rating). But also interesting was that when the widow was…

Accrued Benefits - Reopening - Missing Service Records
As my husband's discharge physical is not in his C-file, and there is not any indication it was ever in the C-file - if I can ever obtain a copy, does that mean I can use it as new and material evidence to reopen any and all claims that were denied because the SMRs didn't show X (as long as the claimed condition / symptom was mentioned on discharge physical)?

Helpless Child
I am not sure my son will qualify as a Helpless Child for DIC. He was incapable of self-support prior to reaching age 18. And he was adopted by my husband. But based on my reading of the law, I am not sure my son is qualified. – however, I have kept his claim alive because I wasn’t 100% certain, and I didn’t want to give up his right to anything he might be entitled to. So I am wondering what to do at this point. I am thinking I should withdraw the appeal. I was going to ask the judge – but getting the VSO kind of ruined being able to ask the judge things. tdiu Dic For 10% Ihd
I was awarded 10% for IHD, 80% for parkinson's, then 100% T&P for TDIU with no future exams. If i pass away from a heart attack, will my wife receive DIC, since my IHD was for only 10%. GOD BLESS

March 2013 Dic Fast Letter
I am sure it is already here somewhere but I couldnt find it this AM for a question on DIC here: http://www.scribd.com/doc/132403480/FL13-004-DIC Also survivors can use the 21-534 FormEZ for their DIC claims. This fast letter says tey are consolidating DIC claims to one VARO and trying to speed up the DIC process. We survivors still cant use ebenefits however. My husband died Nov 2006 from Cardio Pulmonary Arrest. I found out about 9 months ago that IHD was made presumptive to Agent Orange so I filed a claim for DIC. I received a letter from VA that states "We need additional evidence from you" During the veterans Lifetime, service connection was established for post traumatic stress disorder, chronic lumbar strain with painful left hip, and chondromalacia left knee. Service connection was not considered for Cardio Pulmonary Arrest. 17 Month Dic Claim
My husband, whom was a Desert Storm Veteran and 80% service connected Veteran died unexpectedly on 29 October 2011 following lumbar surgery for his service connected back injury. I filed a claim for DIC in November 2011 with the DAV mobile unit. In Jan 2012, I received a notice from VA that they were working on my claim but they however needed additional information.
