C & P Question

Question

my claim has been at local VA for 2 weeks and the C & P exam is done (well, not a actual C & P- the BVA asked for a "new" opinion from a VA Cardiologist and also that my IMO evidence be considered -finally).

I found out that a PA did the C & P report-not a cardiologist at all-and it went back to the AMC yesterday.

and that he had remarked to someone in C & P that my evidence had been quite extensive (tell me about it)

I could not get results of the exam yet. I wonder how the heck the VA could find a PA's opinion having more value than a NeuroRadiologist's- particularly when Dr. Bash directly referred to brain scans of thousands of diabetes he was familiar with who had same type of diabetic brain trauma as my husband did etc etc-

Even if it is the worst opinion in the world- it rests against my 3 IMOs and my considerable other evidence.Each signed by Dr.Bash and the one by Dr. Rabiee and yet this VA opinion would be signed by Mr.---- a PA is not a doctor.

Relative Equipoise would be at hand.

Maybe after almost 6 years I will have a decision at least based on the medical evidence-

(and my IMO doctor's credentials sure outweigh the PA but I will look him up at healthgrades tomorrow-)

Maybe it is almost over for me and my dead husband might be close to Peace with Honor- but I sure am expecting the worse and also prepared to get another IMO if I need one.I have someone who will give sworn testimony too if needed.And I have even more evidence and havent sent it in yet.

I wouldn't say anything just yet, because the new &P could be completely favorable to your claim. If it is not, though, raise immediate hell. This PA is in no way qualified to outweigh a IMO from a MD specialist. This more VAola

1) I think the opinion written by the PA will have to be signed off on by someone with higher credentials

2) Yea they may have to list the IMO as evidence this time around ---

but that sure doesn't mean they'll actually read and weigh it.

I'm like you a bit - kind of pessimestic about IF they will finally do right by the claim.

Hang on to that fresh ammo you still have.

My cardiac exam was done by a PA and it was inadequate. It was signed off on by a regular doctor which makes me wonder since the exam did not include required stress test to determine METS. The PA did include a new diagnosis which was vascular artery disease. So, in fact, the C&P exam has expanded my original diagnosis. I was at 0% for arterioscelorotic heart disease and the PA said no heart disease at present indicated, but I got a stress test at the VA recently. All this secondary to DMII.
