Question

My claim is before the BVA. How can I send new and material evidence,

(a nexus letter), to the BVA without delaying my claim?

James,

Have you received a letter yet from BVA stating that

they have received your claim, and provided your docket number ?

The address to send your evidence to will be in the header of the letter.

Don't forgrt to waive VARO adjudication of that evidence.

I had a BVA video conference hearing on September 12, 2008.

I have never received any correspondence whatsoever from the BVA. On 3 December,2008 I called the Nashville VARO and asked if I had a docket number, they gave me the docket number and told me that the date was April 22, 2008.

Betty,

I got ahold of a man there that informed me that my file was at the AMC and he was going to put in a note that they call me and talk to me about the file. He said that they normally like the info coming from the Records Research Center, but it did not sound like it was a rule set in stone. I am waiting on that to see what it says. I will see if they call me, or write me.

Thanks

Mike

Betty,

Called the number you gave me, and spoke with a gentleman in that office whom told me that since my file was at the AMC he would have a counter-part there get back to me. They called me today and informed that they have the reply from the JRRSC as of Nov 25 (I still do not know what it says), and they have all the results from my C&P's and I should be ready to go to the raters. I will see if I can submit some more things next week if they will let me. I appreciate the help and will keep you posted.

Thanks

Mike

Mike,

I will go through my list of telephone numbers and give you the name

and telephone number of the rater's supervisor at the AMC.

She can bring up your claim and go over it with you.

Always,

Betty

Update, I sent got a copy of the JSRRC Verification of stressors that was sent to the VA. It only half verifies what was requested. The other parts they tell the VA that I need to provide the information.

So today I sent express mail/Certified a package to the AMC with everything and a cover letter explaining what it was. Hopefully they add it to the rest. I have included Military orders, copies of pictures, copies of LES's, copies of Medals statements, copies of certificates, Letters from Senior Officers, and write ups, copies of the manifest that were used for the medals. Just for fun I added my own research including a copy of the court records of an officer that was court martialed that explains the situation, as well as expedia, and other assorted articles. I hope they at least look at it. My situation was unorthodox, but well documented on my end.
