Ssdi Award For Sc Condition And Tdiu

Question

I have been trying to post since the 17th so I hope this one makes it through after a little troubleshooting suggestions from here that I read.

I applied for and was awarded ssdi in 2005, started getting paid Jan 2006 after the waiting period.

This award was for mdd and anxiety with some anger issues.

I was told I needed a payee which I have had since.

I also appled for sc in 2006 due to a shoulder injury and a ulner nerve damage I sustained during active duty. Along with that I also applied for my mdd as secondary to my shoulder and ulner nerve damage.

I was awarded 20% for my shoulder, 10% for my ulner nerve, 10% for foot, and 30% for MDD.

I was also told I needed a fudicuary.

I Filed NOD w/DRO and thats where it sits.

DO I need to do anything else, should I sumit more evidence of some kind or should I let my VSO handle it all?

Welcome to Hadit. Have you provided VARO with copies of your SS Award? You have a VSO which is good but you need to check up on them as many of them are overloaded. If a VSO drops the ball they walk away and you suffer the consequences.

You should take some time and read as much as you can on Hadit. Have you had a Hearing with VA?

You are lucky in a way as at least you have SSD. Know its tough to make it on SSD I did for over 5 years till I won my claim but you can do it.

Congrats on the SSA and VA grants.

What part/s of the rating decision did you filed the NOD on ?

I filed nod on mdd and shoulder and ulner nerve %'s. The va had ssdi report for the first rating so I am a little perplexed why they rated me at just 30%. MDD was what ssdi was awarded for.

I have been having big problems with my dav vso and I am getting ready to send her a letter taking away her power of attorney. She makes me feel very uneasy and seems to be rude at times.

I am afraid of doing this on my own so I am very happy to have found this site.

The SSA award sound like it is the same disability as the 30% MDD.

If I were you I would send them the TDIU form.

(give copy to your SO-he should have given you this form himself)

# 18 Check yes and then under # 25 state you have additional information attached and tell them what your SSA award is for and also the side affects of any SC meds you take that would render you unemployable- like causes drowsiness, dont take and drive, causes confusion etc.You can attach any good internet printout or copy of the side affect

thing that comes with the meds.

If you were ever turned down by VA Voc rehab due to yoyur SC tell them that too.

Here is the TDIU form-next reply -put your C file # name and addy on everything you send them, send copy to the SO too- and keep all VA correspondence.

They should send you a form authorizing them to obtain your SSA records.Dont know how long that will take but you already have the SC for MDD and need the fiduciary - so in my opinion they should award TDIU.

Then again- it seems they should have known of the SSA award as you got it prior to filing the VA claim ?

Did they list it as evidence?

Maybe they have the SSA records already but just ignored them.

As others said- good to have rep but dont depend on them too much-they have hundreds of claims- you have only your claim.
