Former Employer Work Records For Tdiu

Question

i'm at 90% and two of my last employers will not respond to va forms requesting info on work records. one is out of business to my knowledge. will this hurt my chances of being granted tdiu? is our rating decision being based on whether or not my past employers respond? ( both of whom I am not in good standing anyway). also in support of my claim, a VA mental health social worker that i have known for years typed up a letter on va letterhead supporting my claim. i wonder if this will help. any insight is appreciated. thank you all

the VA will make three attempts to get the information from the employers. It will take a while for them to do this. After that they will rate the claim without it. If the evidence you have will support TDIU they can grant it without the information from your previous employers. You also need to send them a statement that the one employer is no longer in business.

I had the same problem with an employer whow would not respond to numerous request. I called and asked that they decide the claim with the evidence that they had. This was after three attempts to get them to respond. They finally did and I was awarded IU.
