Trying For Disability Due To Parkinson's

The thing is that he has to have applied for PD in the past before PD was accepted as presumptive before he can get retro under Nehmer. If he claimed PD ten years ago and was denied then his retro could go back that far. If he first applied for service connection for PD when he heard about it being added to the presumptive list the retro will go back only that far. This is how I understand it. This puts me in mind of telling vets to claim anything that is likely to be added to the presumptive list. It could affect your retro if and when it is added to the list. God knows what will be added in the future but the VBM has a list of illnesses that are most likely to be added. Who would have believed DMII would have been added?

Thanks all for the assistance! I will do both I guess. It can't hurt can it? Do you all think that this will be enough for the back pay to help with the in-home care for a while? We have been trying to figure out a way of doing this to keep him in his existing house for as long as possible. I would think being diagnosed so long ago, it might be the mucho, mucho dinero to quote LarryJ. If so, it could go a long ways to paying for his care for years I would hope.

I know that sounds bad but we are hoping to keep him in the house for as long as possible since the assisted living and nursing homes are not a very attractive alternative, but 24x7 care is a bit steep $$ wise.

Since he is 50% SC'd - if his PCP will state in writing that he needs in home

assistance - VA might have to pay for it by fee-basis.

I'm going to send a shout out to someone that might know.

The VA will send out a Health Aide and a Nurse if needed but the Primary Care Doc has to ask for it. They send and Aide and a Nurse to me 2 times a week and I am not that bad but it has been a big help. The number of hours is limited.

Okay a bit of news and wanted to get your takes on this. I found out that my dad still has the original claim he filed back in '85 for Parkinson's with the VA(which was denied back then). I guess he and my mom called and had them re-open the case. I would think this would be a good thing for his eligibility. Currently he is only at 10% I guess. He is on disability and has been for the last 10-15 years or so.

Since the original claim was back in 85 and had PD on it for the reason, do you think that it might get retro'd back to that point? His payment now is a slap in the face as far as payment and the higher pension would go a long ways to help pay for folks to come out and help.

We have the VA folks coming out now for a few hours a day so that is helpful.

What do you all think of the original claim thing?

I think that, seeing as how you have found this old, original, claim........that that is probably the best "find" that you could have EVER made!

Read my prior post and, on the form 21-4138 Statement in Support of Claim, make doubly sure that the VA is AWARE of this old claim, the dates involved and the outcome of this original claim.

I am not as "up to speed" on this as I wish I were (your posting has caused me to assure myself that I WILL BE, up-to-speed), but, I think that you have found sound basis documentation for an earlier effective date, especially when tied into the current Agent Orange "presumptives" and the Nehmer rulings.

or Reasons and Bases Section as to why VA denied the claim for

Parkinson's Disease ?
