Ftca Offset

Question

http://www4.va.gov/vetapp08/files3/0824103.txt

veteran received a cash payment of $775,000 due to malpractice at a VA medical center under FTCA

The veteran's Section 1151 claim -filed separate;y from the tort- came into play and the VA said they made an over payment to the veteran.

To the tune of 234,372.In 1151 compensation.

This BVA case is a good example as to why anyone -vet or widow- with any FTCA issues-needs a lawyer.

Unless they can spend the considerable time it takes to understand FTCA laws and their relationship to all the VA regulations.
