Question

Hello, I have been denied for a third time for vericose veins which has been noted in my military health records, but the VA denied my claim because I did not seek medical treatment while on active duty. so my question is what do I need to do to be re-evaluated again by the VA or can I ask for another comp & pension exam?

At the rating board for the third time, must be doing something wrong, gave them everything they required even statements from dead people (just kidding). for some unknown reason the VA is stuck on that I did not seek medical treatment while on active duty, so with that saying I think the VA looks at the condition never happened, so what can you recomened at this point?

Considering my observations that military personnel are not encouraged/discouraged from getting ANY kind of treatment while in uniform, I am not surprised that you did not seek treatment while in service.

How could they be noted on your SMR's without treatment?

Did you file for the VV within one year of separation?

Are they noted on your entrance exam or exit exam? If they are on your exit exam without being on the entrance exam, they came about while you were in uniform.

Even if they were on both, did your military service cause them to get worse? Either of these scenarios would cause SC, and there you go.

What are you 20% connected for? Legs? or what? and if you were denied a third time thats quite an effort. What were the denial reasons? And if its in you Service Treatment Records (STRs) thats something; how did the information get there? Your entry physical? or self'report? By the way - what was your MOS? Just adding up the possibilities here.

Best to ya,

Cowgirl

I would ask for a Hearing if it was me. Noting in your military records is proof enough in my opinion.

I get 10% for my knee and another 10% for hearing loss, My MOS was a Tank Commander in the Marine Corps. Entrys were made in my Physicals I had in the last 20 years while on active duty.
