Should I File Now Or Wait

Rate this question

Question

I am currently rated at 70% for the following:

20% DM II

30% PN left upper extremity

20% PN right upper extremity

10% PN lower extremities bi-laterally

I have a claim submitted for an increase in benefits for lower extremities which were rated as mild but are now severe and have had my C&P exam. Should I file for TDIU now or wait until this claim is settled? As I understand it, when a certain % is reached for a common etiology, TDIU is infured. Any thoughts or suggestions appreciated.

You'll NEVER get TDIU until you file the "proper" claim form:

http://www.vba.va.gov/pubs/forms/VBA-21-8940-ARE.pdf

I repeat, you'll NEVER get TDIU (oh, I suppose someone in the past HAS gotten it, but DO NOT BET ON IT) unless you use THIS form!

It is fillable on this site above, but not saveable, you'll need to print it out after you fill it out. Then either take it to your local VA Regional Office, or send it USPS or UPS or FEDEX, etc., with proof of delivery. If you take it, get a copy of what you gave them, date stamped as received.

Oh, and by-the-way, to answer your question concerning whether you should file now or wait.............remember one thing, your bennys don't start until the claim is filed. Otherwise you are missing out on REAL money the longer your wait.

So, PROTECT your Earliest Effective Date by filing as quickly as possible...............trust me on this, okay?

They are correct - do what they say. I call them the Sages - they earned it.
