My BVA Motion for Reconsideration was Denied 3/23/10 --however, the BVA did refer my (ammended) CUE claim to the VARO for initial development!! So, it ain't over yet, in fact, it's starting all over again. I don't know wheather to laugh or cry ...

My Claim involves a non-final, 1988 decision and a rating decision of 1999. Instead of filing CUE on the 1988 non-final decision, I SHOULD have filed CUE on the 1999 rating decision. Ah well, live and learn.

My CUE claim has been nearly perfected and has been "referred to the Regional Office for appropriate action". ~~~Wings

Another day, another battle! Unless I withdraw my claim, this will probably be another 5 year go-round. I think I'm ready --just wish my personal problems at home weren't so overwhelming. I am looking for a new place to live ... Thanks Carlie! ~Wings

If it gets to be too much see if you can hand it off to a lawyer. So he/she gets 20%, big deal. You can go on about your business and let the lawyer look after it. It probably will take a few more years.

Don't I remember that you have a young one at home? If that is part of your strife, try to remember that they eventually grow up and become hopefully human.

Wasn't the "Reconsideration" sort of just a delaying tactic while you decided whether or how to go to the CAVC??? Also, you can still file a CUE on the 1999 decision. There doesn't have to be just one CUE claim.

PR, The BVA has forwarded my 1999 CUE (developed on appeal) to the VARO for development. I'm going to keep fighting this as long as I can, but will probably solicit an attorney. ~Wings
