Question

This is report from my c&p NOD for Anxiety Disorder which is already rated 30%. Any ideas?

EMPLOYABILITY: Poor

DSM-IV DIAGNOSIS

Axis 1: 296 Major Depressive Disorder: 300.02 Generalized Anxiety Disorder

Axis 11: no diagnosis

Axis 111: Diabetes, HTN

Axis IV: Marital Discord

Axis V: Global Assessment of Functioning (GAF): 50

MORE THAN ONE MENTAL DISORDER:

The following is accurate for this veteran: More than one disorder was diagnosed.

If more than on Disorder was diagnosed, explain the relationship of symptom of the two or more conditions and their relationship to Veteran's Military Service time. If this can't be done, please state this and explain. He has been diagnosed with anxiety disorder since VN and it is therefor more likely than not related to his military service. In terms of his depression, which appears on this interview to be his primary difficulty it is speclative at best to separate this from his anxiety disorder as well as his military service. The seperation/conceptualization is made more difficult with the history of alcohol and substance abuse.

"more likely than not" is good. They recognize you have disorders related to service.

"speculative" could be a mixed bag. I'm interested in seeing what others say about this too.

Brother Gate,

I see you are currently SC'd at 30 percent for a MH disability.

The statement made of,

"He has been diagnosed with anxiety disorder since VN and it is therefor more likely than not related to his military service.", is not of any relevance as you are already SC'd for MH.

In my opinion I do not see any medical evidence or rationale in this report

that shows support for an increase.

In my opinion it's a piss poor C&P.

This is a poor exam. The doctor's bringing up the alcohol and substance abuse is not going to help you unless he says it is a result of your anxiety and service connected depression. He will not even say the depression is part of your service connected anxiety disorder. You need to hire your own doctor. This gives the VA raters a lot of room to say there is no evidence your depression is SC and that your real problems stem from substance abuse. You don't want that.

Brother Gate,

Another thing to keep in mind is that even though you have

a comorbid diagnosis of Major Depressive Disorder and Generalized Anxiety Disorder,

the VA only compensates under one MH disability.
