What happens to new evidence if a veterans submit if after his/her file goes back to BVA after it was remanded? Will the new evidence cause it to get remanded again or will BVA use the evidence and make a decision. The new evidence is on a claim that was denied, the veteran appealed it and VA never processed it, so BVA remanded it and a new C & P exam was given in 2009. Now I have more evidence after the C & P exam but BVA has not made their decision.

Yes, the BVA can remand it back to VARO again for their consideration.

My suggestion is to submit a signed Waiver of VARO Consideration, to the BVA

and specify that it is for the new additional evidence you just sent them.

I would do this ASAP and mail it RRR.

Then I would wait about 15-20 days after I got the RRR back and call the

BVA to verify they have it of record.
