I have, over the last couple months, heard several of our new (and some not so new) Hadit members make statements such as "We're waiting, and as soon as we get an increase in my disability percentage well, then we're going to file for TDIU."

REALLY?

GEE?

WHAT THE HECK ARE YOU WAITING FOR? NO, REALLY, WHAT ARE YOU WAITING FOR?

If you even have the hint of possible success in filing for TDIU, DO NOT WAIT for some other increase, or whatever. JUST FILE your form 21-8940. BECAUSE YOU ARE COSTING YOURSELF MONEY. SERIOUS MONEY!

After all, when you file the proper form, you ARE filing for an increase. If you do NOT file the "proper form" then the VA is not going to "inferr" that you qualify for TDIU.

COME ON FOLKS!

SHEEESH!

I've added up the number of folks on here in the last couple months, plus the folks that I have coming to me OUTSIDE of the HAdit Forum and I've counted 11 people that I remember.

ELEVEN. THAT I KNOW OF.

And, most do not and will not, file for the proper EED.............geeee, just look at all the money you saved the VA. I, for one, am proud of you...................... :blink:

Larry,

I appreciate you post, but my wife has CML (luekemia) and is totally disabled SSD since 1999 herself and I have to do most of the cooking and cleaning when I am home, so that is why I still have to commute. If I could apply for TDIU and still be working then I would be ok, but I understand that isn't possible.

It's of course possible and allowed to actually file the claim for IU

BUT

in my opinion it would just be a quick denial.

Well I am 60% service connected and having pending claims for Sleep Apnea and IHD and CAD. The only problem is I am still working and can't quit unless I am 100% TDIU. So it is a vicious cycle and I am not sure what I should do. I am having a lot of trouble at work due to my disabilities and have alot of trouble staying awake with my 70 mile commute in the morning. Any suggestions?:blush: Edb

How long have you been working at your current Job? Do they offer any type of disability retirement? You may want to check this out, keep in mind what will happen if you get worst. You also might want to find out if one of your doctors would write a statement that you can't work due to your service connected conditions and go from there. In my case I was worried about losing my Job after my VA rheumatologist told me my condition would get worst but I could not quit until my back went out and I had no choice. Since you are already having problems, it may be best to find/ search all the information that you can

I've been following this topic since LarryJ initiated it. Everybody I have spoken to, including my VA Vocational Rehab counselor, has led me to believe that you had to have 70% before you could file. Thanks to all for this valuable information.

If your Doc would put in writing that you need to quit working with more reasons than just does not want you to drive 180 miles you probably would not have to long a wait. We have a Member who did this and got his award in a pretty short time.

Its really tough but in my opinion you will not be able to help your wife if you have a bad accident.

I applied for an increase for my depression back in Feb of 09. I used the form the VA sends you to write how you believe your disabilities affect your daily activities. Sorry don't know the form number. I mentioned on that form that I had not worked in over nine months. The VA then sent me the TDIU form and suggested that I fill it out. I had never heard of TDIU much less knew to apply for it, and my VSO never once mentioned it. This was about the time I found HADIT and filled out the form per the advice on this site and I was granted IU in Aug 09 going back to Feb of 09. I agree with Larry had I not waited and filed after losing my job I could have had an earlier effective date. I did however, use the advice of this site and appeal the denial of P&T. I just recieved a letter from my VSO saying I was awarded P&T back to Feb 09. I have not received the official letter from VA yet.
