Ptsd Increase Denied

Question

I filed my claim in 02/09 for PTSD and tinitis .I think in 9/09 I was awarded 50% PTSD and no mention of tinitus .Took hearing test in 10/09 denied tinitus .I have 2 PH from Nam and one was a head wound??VSO with MOPH said file NOD for increase on PTSD and tinitus.Filed in 01/10..Received denial 07/08/10 with no mention on tinitus issue.Letter from VA enclosed an VA form 9 and instructions.Contacted MOPH on advice..Says she is real busy..Has opening for an appointment in couple of weeks.Wants me to come see her.I live 85 miles away 170 round trip.Unemployed for over a year..Having lots of trouble with moods.Please advise...---...

Why did they deny the PTSD increase?

Can you scan and post here their reasons and bases (Cover the personal stuff)

When you appeal this with a NOD I suggest that you attach a TDIU form to the NOD and refer to it.

But maybe best to tell us more-the actual reasons they denied for PTSD.

"Took hearing test in 10/09 denied tinitus" Did you formally file a NOD on the tinnitus denial?

I hope I did this correctly one of the pages are or should be blank,however this is from the VA info they sent.There is no mention of tinitus and a NOD was supposed to be filed with the PTSD by MOPH on it at the same time..I haven't been to the srink because I just do NOT want to talk about Nam and I stopped taking the meds they gave me because they made me have no feeling at all.I am mostly house bound because the smallest thing pushes me over the edge.The lady at MOPH said she wanted to get 70% then file for TDIU..Now everyone is to busy.to help me.I know I should have gone to the srink but talking about this distresses me so much and being...---...

Unfortunately they did hinge on the lack of treatment and lack of medications in the SOC you posted.

VA justifies it's PTSD ratings often due to the veteran's participation in some sort of treatment program. Even if you didnt see the shrink for PTSD -d0 you have any Vet Center records they could have considered?

I think you better check with MOPH on that NOD.

Hmmm not to be tough on you and I do agree that you should be 70% but that write up is not going to get you there, it could have gone either way. At least I think so.

I know it is a pain and I hate the meds too and have changed 3 times already and really they still are not right. In my opinion you are going to at least start going back for treatment for a while and also to the Vet center so they can help you handle what you are going through right now. That is first!

Talk to the VA shrink and do not hold anything back like us big men like to do! Tell them your problems and I feel you will be rated and written up properly.
