Thank you all on Hadit who gave me some good advice. A very special thanks to Berta.

60% for DMII, PNx4, Macular Degeneration, and SMC-K for ED.

Effective date December, 09 2009.

IHD, Hep-C, and IU deferred.

PTSD and Retinopathy denied.

Congratulations! Stay on them about the other claims.

Also, if you were not 50%+ prior to this award, check your effective date and visit your VAMC business office. From the effective date of being awarded 50% or higher, they are not allowed to charge you for copays at the VAMC. This could mean some extra cash for you if this is the case.

I agree completely with you about reimbursement of co-pays back to your 50% effective date. I have been trying for about a year to get mine back. All the reps on the phone are very polite and agree I am due a refund but guess what - it never arrives. Lately I have been calling the patient advocate - he agrees also - but guess what - no refund. It is several hundred dollars. I'll keep plugging away at them.

It was great to read this today Rotorhead-I have been taking some time off the board and am glad I checked in this AM-

with the deferred issues hopefully, this could become a TDIU award.

I forget-did the diagnosis of IHD come prior to the DMII diagnosis? Therefore it wasn't secondary to the DMII?

If so-I think many many veterans have a chance now with the new proposed regulations for IHD-to get their IHD SCed due to AO.

But I think-in cases like yours- the TDIU claim you have might be deferred until the IHD regs come into play -so they can rate with the IHD too,but the TDIU EED should still be date of the TDIU claim.

I am surprised that the retinopathy was denied.

Did they give full medical rationale that is it not diabetic retinopathy?

With some retro you might consider putting some away if you should need an IMO from a specialist.

I assume they gave you 20% for the DMII ??? Is that correct per the rating schedule? I add this up and get 70% but I sure am not good at how they determine VA funny math.

I am hoping that they will award TDIU you and then SMC for the IHD if it is ratable at 60% or more.
