C&p For Depression (Never Had Exam)

Question

One of my claims is for depression. The depression is caused by illness, which was caused by illness on and after active duty, service connected.

I am rated at 50% for illness from Jet Fuel, on active duty.

I have claims in for more ilnesses, and also for depression. The depression is from the illnesses. I was never see for depression on active duty.

I just had two C&P exams for neurological issues, and for medical. I was never sent to an exam for spression for my claim.

But, I have been seen many times for depression at the VA for 15 years.

I just wondered why they never sent me for a C&P exam for depression. maybe they have enough evidence for the depression with more exams?

I expect the rating decisions soon.. as it's been a months now (C&P exams wre in July 2010).

I think you're right - they may have enough evidence without a C&P exam. Have you been seen by anyone outside the VA? I would still send an IRIS question, or contact your VSO if you have one and ask the question. Don't take anything for granted, though.

If you are asking "Can they make a decision on your claim WITHOUT a C&P examination, then the answer is YES. If they have enough information to make a decision without having to go through a C&P exam. If you have been treated for depression via the VA and have a treatment regimen and history of depression, then I would think a C&P would certainly be un-necessary.

Quick question, did you get a copy of your C&P exams to see if documented? Just a thought.......

VA can process your claim and make a decision without giving you a C & P exam. If a veteran files a claim and VA does not process it, deny it, or low ball it , the veteran can then file a claim for CUE for that issue. If the veteran has well documented evidence in his or her file and VA fails to process the claim then the veteran can ask VA to reconsider the evidence and keep his or her original claim date.

no copy of any c&p's... I am just awaiting the decision...

if I look early, I might have a hear attack..

If the VA does not send you for depression c&p I would be suspicious. Did your VCAA letter list depression as one of the disabilites you claimed?
