Question

50% Depression/Anxiety/Agoraphobia 30%Migraines 30%Coronary Artery Disease...I filed for TDIU in Aug 08..was denied and I sent NOD. Went to Voc Rehab was found eligible but infeasible due to SC conditions in 09. Just got waiver on RH insurance premiums for totally disabled. Would it help if I fowarded the life insurance letter(SC VETERANS LIFE) stating they rate me as totally disabled? Also have C&P exam for re-evaluation that I just had like 9 months ago isnt this a bit much? VSO says NOD is up for review in Febuary. What am I doing wrong?

After two years you probably should consider telling the VARO that you plan to file a Writ of Mandamus if you don't hear back from them in 30 days.

Can I do that since the NOD was filed like Apr 09?

Yes I would that is 16 months after you filed the claim 2 years ago. Remember that filing a Writ is just putting pressure on VA to move the claim along. No one wins a writ but oftentimes the claims is finished shortly after filing.

How would I go about doing a writ ? I called the VA and the DRO has had all the info requested since May 10th...also should I send in the letter that the VA life insurance has waived my premiums and consider me totally disabled?

If you say they are sending you for another C&P then it sounds like they are moving on it and after they get the results from the C&P I would not think it would be long.

Are you signed up for ebenefits? After you are signed up you should be able to see where your claim is but also your VSO should have a answer for you.

I am not sure on the writ thing so someone else will have to help with that.

I can tell you my last NOD took well over 18 months and is waiting at the RO to be certified for the BVA since June of 09 and has not been sent. Maybe the RO will look at it and grant but I am not holding my breathe!

Did you have a letter from a doctor saying he could not work solely due to his SC conditions? That is what you need for IU, but voc rehab turning him down should be enough. Why was he denied IU?
