Question

I must not be overly bright. I am so confused about unemployment claims. If I get 100 % for IHD, can I also file additionally because I cannot work? I have been on Social security since 1992 on a non service connected illness.

IF you get 100 & for IHD, filing something additionally with VBA in regards to your inability

to work will not get your anything extra.

Now to really confuse you - you might meet the criteria for some SMC.

I received 100% for heart, had a claim in for COPD and was told it was set aside because once I became 100%, that was all I needed. Not I am house bound and on oxygen 24 7 and my wife has had to quit work to care for me. Is there additional help for me to off set the loss of her salary?

You have to be careful on who "told" you that. If it was your VSO, they are often motivated by laziness. It is not accurate that "COPD is set aside once you become 100%" as follows:

If you are housebound, the max is NOT 100%...instead you can get Special monthly compensation for things like housebound and aid and attendance. One way to get SMC is through 100%, plus an additional 60%. Another way is "housebound in fact".

Aid and attendance, however, is higher than housebound, so if you are eligible for A and A, you should go for that.

By "setting aside" your COPD, they may have made you ineligible for SMC, as, 100 plus 60 equals SMC. So you may need the COPD to get a higher level of SMC.

On O2 is also a percent rating.

who told you to give up the lung claim and do you have ity in writing

If it was the RO then that is the wrong answer.

if it was a vso then yuou may be able to go after them for their bad advice.

We have had members here to sue the crap out of a VSO for bad advice.
