Deferred Decision On Claim For Ihd/ao

Question

Denial info for hypertension claim posted in Claims section. The claim was for hypeertension secondary to ischemic heart disease/ischemic heart disease based on heribicde exposure. But, along with the denial for hypertension, this is the communication from Seattle RO about IHD/AO claim filed last October!

"We have deferred a decision on your claim for ischemic heart disease based on herbicide exposure. However, this disease has not yet been added to the Dept of VA regulations governing diseases presumptively associated with herbicide exposure. In order to add this disease, we must follow a series of legal requirements, including publishing a notice in the Federal Register. We have begun this process, but are holding your claim until these legal requirements have been met. When the process is complete, we will make a determination on your claim and provide you with a notice of our decision.

Lorraine- I replied to this in the other forum but you gave us more info here-

this is good because I suggested spelling it out as to the secondary in an addendum to the claim and now I see you have your ducks in a row here.

However, it will take a medical statement to connect the HBP as secondary to the IHD.

If your husband gets private cardio care maybe the private doc will prepare an IMO to help with that medical statement for little or no fee.

A VA doctor might establish the connection but then again they might not.
