Letter For Dic And Autopsy Reports

Hi Everyone

I have a quick question. I just received a letter from a VA doctor where my husband was seen when he was alive. He states "it would be more likely than not that his renal disease is service connected." The question is it is listed on his discharge summary from the hospital (when he passed) chronic kidney disease., but it is not listed on the death certificate, but it is also listed on the autopsy --infarct of kidneys. So can it be said that he died from kidney failure also....can it be linked to the renal disease from service. Could it be a contributing cause of his death? Does that make sense? Sorry if it does not.

Did he give a full medical rationale for that statement?

Was your husband's renal disease service connected in his lifetime?

I dont read any nexus there at all.

The VA will focus on the exact wording of the death certificate. An autopsy can enhance and detail what the death certificate states.

What did your husband die of per the death certificate?

You could use the VA doctor's statement for your claim but I hope it completely conforms to the IMO criteria here.

My freeby email IMO from a former VA neuro didnt confirm to the IMO criteria but I had 2 more IM0s that did and the VA gave them all equal weight.

The former VA neuro doc however had treated my husband in the VA and remembered the case well.

Kidney infarction can lead to kidney failure and sometimes not-

A lot depends on what the death certificate says as immediate cause of death and any contributing factors.

I thought you had s very strong IMO on another basis for the DIC claim.???

Yes, I do. I have already mailed it off. This doctor I had asked about 3-4 months ago to write a letter. This was before everything with the IMO. I just got the letter today so I was going to mail it off, but he only focused on the kidneys and the other doctor focused on the blood clots. So I have one IMO for the blood clotting and then I have a letter from the VA doctor who focuses on the kidney disease.

Not too much detail was given. This is what he wrote.

"At autopsy there was evidence of renal failure. There is evidence of an elevated creatinine of 1.5 on April 29, 2009. Also in 2005, approximately eight months after his discharge from the military he has a documented elevated creatinine of 1.4.

I have reviewed the medical of ______________ ___________. In my opinion, a presumption of the development of his renal disease prior ot his discharge can be made from the proximity to discharge and his abnormal creatinine levels. It would be more like than not etc....

The disease itself was not documented until a year before he passed.

Per the death certificate, pulmonary embolism, hypercoaguable state and ischemic bowel--basically blood clots.

I don't think it confform to the guidelines. What do you think I should do? My first IMO is much stronger

Thanks for adding this info- it is better then I thought.

By all means send it to the VA.

You have raised two reasons for potential service connected death.Two are better then one.

They will only award DIC for one SC cause of death but this covers 2 basis.

Sometimes I think vets and widows forget they can raise any theory at all for entitlement.

I raised 3 theories (with medical evodence) and succeeded with proving two of them.

It isn't always possible to do that but cant be overlooked as potential way to get SC.
