Question

I am 100% IUE with service connected PTSD and HEP C. Medication side effects effected my ability to maintain employment; resulting in IUE.

I filed a claim for aid&attendance because of my inability to maintain personal care. Also. unable to perform unassisted personal tasks in the couumunity

The RO denied my claim. The rater stated that I choose not out because of anxiety and fear of the public. C & P exams from both mental and physical doctors

have evidence supporting my claim. The RO admits to having medical records from 2008-2010. The rater stated that I did no meet the criteria due to my rating

" you do not have a single service connected rated at 40%. I am 40/70

JABBO - when did the VA deny you for A&A? If it hasn't been a year then it can't be CUE.

. Claim denied in august 2010. In was denied dec. 2010. I filed appeal jan 2011

and requested a hearing w/bva

It can't be CUE until August 2011, one yr after the decision date. I would have filed a NOD stating a "grave procedural error" and requesting that the original rater correct their decision or the same but requesting a DRO hearing. As it stands, I see 3-5yrs before there is any kind of resolution, if there is any resolution. jmo

I had to prepare an A & A claim recently due to the new IHD regs regarding my deceased husband.

I followed the A & A regulations to the letter- remember not all of the criteria has to be met in the claim---

But I only made specific statements that warranted A & A that I could back up with (and I enclosed copies of) clinical med recs, day treatment records etc., and I did give a personal statement too as I was caretaker.

I also refered VA to my husband's SSA awards as to his A & A standing, his driver's license, and numerous other documents that supported the A & A yet were not part of his VA med recs.

I dont anticipate problems with the A & A claim but just in case-I found someone who is listed at Dr. Bash's site as an expert in Aid and Attendance claims.

I emailed him Saturday for some idea of what he charges for a A & A IMO,in case I need one, and what his expertise actually involves.

I will let you know when I hear from him.

That sounds like the HB award should have been considered (SMC S)

Can you scan, and attach (cover personal stuff) the actual Reasons and BAsis for denial?

Have you been diagnosed with agoraphobia?

It s not unusual for a PTSD vet to have agoraphobia.

Yes! Agoraphobia is diagnosed. The rater did not discuss the c&p exam that provides this information. Also, I provided medical information with explanations of the disorder.
