Bva Choice- Travel Hearing Or Not ?

Need help understanding BVA -hearing process.

I received notice that my requested travel section hearing has an estimated wait of 325 days.

It says I can withdraw my hearing request and have my case immediately forwarded to The BVA.

My question is: what is the advantage of the hearing .

It seems that it would be less wait without it.

If I submitted a detailed explanation of disagreement, would there be much benefit to a hearing.

I guess I am not sure what happens at the hearing other than explaining verbally why I disagreed with the decision

I am also concerned that I might be too ill to make the hearing, so a VSO might be representing me.

Should I wait for a hearing or should I withdraw request for it so it goes to the BVA quicker ?

I agree.

And remember- once transferred to the BVA, you can still send them more evidence right up to the day they decide the claim.

I sent additional evidence directly to the BVA when I was there and then I contacted either the BVA ombudsman or called the BVA to make sure they got it.(I sent it USPS Priority with Tracking slips too.)

I had a BVA hearing. It lasted 15 minutes. It did not influence my decision at all. I would not waste my time with such a hearing. I had a lawyer and he submitted a brief and it made no difference. The whole process takes too long as it is for the result you get which is often a remand.

Thanks for the advice.

I was actually thinking that there must be some big advantage to having a hearing,

but was not sure if it was worth the extra wait.

It is difficult to wait when very ill.

I guess I need to withdraw my request for the hearing.

Does anyone have an idea how much quicker it will be without a hearing.

My guess would be 1 - 3 years without a hearing before you would

have an answer, and about 3 - 5 years with a hearing.
