Has Anyone Sued A Qtc Doctor?

I finally took the time to read my C&P Physical that a "doctor" from QTC performed. I will wait for my rating before I take any action because I have been waiting since the dawn of time. I was rated 20% for DMII, but appealed stating that they did not take into consideration my other medical issues that could be related to DMII. According to the worksheet I was suppose to get an eye examination by a professional. The exam consisted of a chart on the wall. I could barely make out the biggest letter. No other test for eye disease was conducted, but I have perfect vision now. I had ask the Doctor if he was going to exam my Back, and he said on what is on the worksheet. He did have me do the motion bit, and I could hardly move, had trouble walking, etc. From his report , you would think that I was dancing with the nurses, swinging from the lights, and doing backward somersaults. I was hurting so bad that day, the Doctor even helped me get my shoes on. But, what is really bothering me is that he told me that he could not exam my back because it was not part of the examination. However, he did a mental evaulation of me, and a mental evaluation is not in the worksheet unless I overlooked it. Besides he is no mental health expert. I only answered his questions and tried to obey his medical commands. From this, how can he state that I have the ability to manage my own financial affairs, that I'm alert and oriented times three! Maybe, my error was that I had taken my mental pills. I will wait for my rating to come through, but I would still like to snap is skinny neck.

He is simply stating they are are not incompentent. The only reason the VA will propose to find you incompentent is if you can not handle your finances.

Papa,

What is it you would sue the QTC doc for - they don't provide any medical treatment ?

If the back isn't being questioned by the VA decision maker then the doc is not supposed to examine the back.

Sharon already addressed "the ability to manage my own financial affairs".

"alert and oriented times three" is nothing more than if the examinee is orientated to person, place or thing,

like the day, month, president, whether it's day time or night time, something very simple.

Sometimes, I just get very fustrated and paranoid about all this VA stuff. Maybe he did me a favor on the mental part, as I do not want to get a fiduary(sp) involved. But, that motion thing and the eye exam still bothers me.
