Recently Sc'd : Could There Be Retro Pay?

Question

i was recently diagnosed with ms and service connected for it.

C&P exams have returned this disease started on active duty in 1986 and that i've had it since then, along with spinal disease, and mood-disorder(secondary to MS), for all these years. though they never admitted to this until recently. it was always something else : you folks know the drill.

is it going to be an up hill battle for retro or am i actually legally qualified for retro pay? the whole issue is confusing to me although i have the pva helping me. often times i just can't get a clear picture of this. and with years of mis-diagnoses and mis-med-treatments, i don't know who to trust in this matter.

i was discharged for spinal problems and with dep (secondary to chronic pain due to spinal problems)

the MEB(med eval baord) dismissed the MS tests as being false positive and dismissed a few other things that were clearly pos in my mil med records. which the va now agrees to.

so, as for symptoms, yeah, i had them then, and the records clearly shows it.

oh well, its all confusing as heck to me some days

When did you file your first claim for VA Disability/Pension ?

What is your 30 % SC for ?

What was the effective date of your initial compensation ?

honorable medical (herniations, chronic pain syndrom, depression secondary to (chronic pain)

yes, put i paid that back when they put me at 30%

1986 or 1987

herniated back, depression (secondary) though the VA changed the diagnostic codes right after i left the Navy. not resembling much of what the Navy listed my conditions as

tried to get that changed via pva a few times. the VA wouldn't budge on it

>What was the effective date of your initial compensation ?

4.1.1987 20% service connected for back strain

then they added 10% for depression.

like i said they totally disregarded navy med diagnosis, changed the navy's codes to things lesser.

the PEB ignored 3 CTs for herniations and nerve root issues, 3 positive ortho evaluations, 3 positive spinal tabs, neuro symptoms...all documented.

i first filed for SSD June 1987, it was denied.

It seems like you need a couple of civilian doctors to write a letter for you, detailing that what you were originally diagnosed with in the service is directly linked to the MS diagnosis you have now. The VA doesn't need ironclad evidence of the link. They are looking for direct statements from a medical professional that links what you had back then to what you have now. I recently received 10 years of retro pay, and what the VA said in my award letter was that they were not able to disregard the opinion of a medical professional.

i obtained a few of those and the two c&p doctors said the same thing.
