Question

Hey all I trying to get my sea legs on even through I was Army I keep looking around and finding new areas and I think I finally found the proper place for this question, first quick back story. In 1982 I did an exit exam from svc. got denied for Lt knee & shoulder and low back but Rt. knee 0% S/C. History of related health issues over years 1992 diagnosis complex sleep apnea , 2002 diagnosis perpherial polyneuropathy no response surial nerve both legs racked up to tech error,2004 our of work 4 months straight after 4 years extreame low PO2 levels took time going to all specialist and medical center within a 200 mi radius then just fixed itself, 2006 another nerve conduction study same as 2002 and again blamed on tech error, 2008 Lt. shoulder surgery due to large bone spur popping into rotator cuff cutting into it, Then 2010 Lt. knee replaced lost my job for too long out of work. Since lost job also lost Ins so started going to VAMC for care, applied for increased eval for Rt. knee, re-open for Lt. shoulder & knee, 2011 applied for SSDI awarded in two months and back dated to Sep 2010, For last 26 months have been playing 6 mo. updated with VA on Nov 7 2012 Got latest update request for claim this time because I sent them a note from my PCP at VAMC stating I was T/P disabled and unable to maintain gainful employment they sent me a VA 21-8940 to fill out and return. Should I return the VA 21-8940?

Thanks for any feedback Rich!

"Should I return the VA 21-8940?"

YES!!!!!

Lots of info here on the 21-8940.

Is the SSDI solely for your SCs? or any potential SCs

Under Remarks (# 25) refer them to an additional page, with your name, address, and C file number on it , and tell them about the SSDI award if solely for SC.

Tell them if VA Voc Rehab ever turned you down for SC conditions.

Tell them the side affects of any SC meds you take that hindered your employment.

However .....I assumed something but I might be wrong:

"I sent them a note from my PCP at VAMC stating I was T/P disabled and unable to maintain gainful employment."

Did that note specifically provide a nexus of the potential TDIU solely to your SC disabilities?

Do you have, via your SMRs, 201 file etc an established inservice nexus for what the VA will consider for the TDIU?

Obvious the Right knee at 0 SC has gotten worse and could have aggravated the left knee with the polyneuropathy secondary to that.

and to add low PO2.....

were you an Army diver with the 544th Engineer ..... or any other diving unit? If so when did you get discharged.....

I feel there is significance of this problem to the other problems you mentioned.

What did VA or any other docs attribute the low PO2 to?

Hey Berta, Thanks for the feedback, First I was a driver for the Burial team out of Ft. Ben In. As needed when my team was called out for two yrs then a stand by duce and half driver at Ft. Wainwright Ak. 4/9th Inf for another two yrs mostly in the field and on redeployment back to unit offloading C130s'. But also lots of field time in Alaska in tents with sorce of heat was deisel burning yuk stove we burned 24/7, and one specific exercise where it was -88 f with windchill -125 f and we were called on line every other 30 mins. for three hrs. then after went back to regular preminter guard changing every 30 mins I started and got left for 1 hr. 10 mins straight and when I finally got back in my tent I laid by the yuk stove in serve pain as I thawed out by the yuk stove for four hours straight I actually felt my leg bones popping as they thawed. Second my SC for Rt. knee is 10%, and I have a claim in for increased eval on my Rt. knee and new claim on my Lt. shoulder & knee, lower back, and secondary arthritis all areas, perpherial polyneuropathy, and depression in since 11/03/2010. Finally the note from my PCP at VAMC and SSDI are both for arthritis, neuropathy, and depression, and the extreame low PO2 was in discovered in 2004 23 yrs after ETS. Hope this gives you a better picture of my question and advise needed.

Again many Thanks Rich!
