Claim Initially Denied By Va For Ptsd-Recently Diagnosed By Va With Ptsd

Question

In March of 2006 my claim for PTSD was denied by the VA. Earlier this month (November 2013) I was diagnosed by QTC with PTSD and Depression after my C&P exam. My question is should my retro go back to the original date of March of 2006 when I filed the first time for PTSD?

Have you received SC yet ?

Just because an examiner provides a diagnosis - more than that

has to be done first, for SC to be granted.

Yes Carlie, it is service connected to my time during Desert Storm, 1991-1994.

I agree with pr, get the disability service connected. Then you can work on your EED. I'm willing to bet that your current claim will have an effective date of when the VA received your present claim. When you receive your decision, take it to your VA medical health provider and have the doc write a letter, that he /she believes that your condition is sc back to your denied claim and also state why they came to that decision and also mention any previous case studies that may have been used in the decision.

Have you received a rating decision from VBA stating you are service connected for PTSD ?

If yes, what exactly does this decision state regarding an effective date ?

When the original claim was denied, was there a VA C&P exam? If not, you can argue failure of due process, if everything else fails.
