Another C & P Exam?

Rate this question

Tinker

Question

I just got off the phone with the rep at the VA who stated that there was a letter sent out for me..QTC scheduled me for another 2 C&P exams to be done in Columbus, Ga. I just did two in September. I filed for IU increase but never heard of having to do this again. Any suggestions as to why this is happening?

IMHO...I can understand having people take C&P exams in order to re-evaluate their current condition for improvement, but...If those in charge are serious about eliminating the backlog, wouldn't it be smart to focus the time and money on that?? Put a 1-2 year moratorium (sorry if misspelled) on wasting assets in this way and focus on things that HELP veterans. Perhaps I am biased but it seems like the workload is not being prioritized...Hey, it's not a perfect world but those are just some thoughts!

Re-exams are not scheduled just 1-2 years out, unless it was a temporary rating,

say for convalescence.

I think it has more to do with the increase. They called me today and said that I would be going to a private facility for an appointment. I have never had a good encounter with a contractor.

The private contractors are usually better and have a lot of respect for the Military. When I was stationed in New Orleans due to Katrina damaging VA hospital, I had most of my C&Ps thru private DRs and they treated me better than the VA. Good luck to you either way.

Thanks for your replies. I checked some older posts to get an idea. Yeah, someone had something regarding competency exam too. From the look of it, it could be anything from what everyone suggested. I've seen more negative responses on the "QTC" topic. I have a few things going on such as determining competency since I wasn't aware of this site last year and told the C&P examiner I have family help out when it comes to paying my bills... red flag..the VA started sending me letters stating the competency of handling my affairs would be determined. This was last Nov (1st decision). I put in for an IU increase in Jan., had a C&P exam in Sept and now the QTC next week. Now my neck and back is currently 20&10%, Mental is 70% combined 80. The exam for my neck and back has worsened tremendously as it states in the notes from the C&P so yeah, it could be any of it and will see when the time comes. I just thought once you go for your C&P, that's it but guess not.

as previously stated, unless you are rated permanent and total, or you have been rated for the disability 20 plus years, the va can call any veteran in for a c/p examination, at any time. The c/p exam is an important step of the process, which everybody knows (or should know). You miss the appointment or attempt to reschedule it, almost always the claim will be denied. I've assisted too many veterans that this has happened to. It seems that this "process" has become more prevalent the last two years.

Again, many of us speak about IMO's by an independent Doctor. These, not only are the most crucial part of the claim disposition, they should (and most do) place your disabilities in sequence and how they are intertwined with each other to have an opinion of the veterans overall performance.

There are case studies that claims have been overturned in the veterans favor when done by a specialists in the particular field of study. Many times the c/p examiner is not a doctor, and the IMO will eat up the examiners notes and diagnosis/prognosis. I preach the IMO's to veterans that I truly believe will need one. Not all claims will require an IMO.

I have also seen situations like this; the veteran goes to a c/p exam and due to no fault of the veteran, the claim sits forever on some ones desk. Depending on the disability, if the c/p exam is 6 months or older, then the va will schedule you another one to have a current in your records.

If you are determined to be incompetent and have a fiduciary handling your financial matters, I have seen many veterans receive the TDIU without even asking for it.

But, don't go out and say your incompetent just to obtain your TDIU, I have seen stranger things though.

Any disability that is claimed under mental health conditions, and if it's not P/T, you will find yourself in c/p exams every 1-3 years.

I have taken what I have learned and witnessed the past 8 years of being a veterans service officer to disseminate the above information. You're not going to find in the 38 CFR, much of what I stated above, but again, it's what I've seen and witnessed.

Good luck Tinker!

The VA can schedule you for a C&P exam anytime they care to regardless of how long you have held a rating!

The 20 year rule prevents the VA from reducing your rating on any disability that you have held for 20 years or more, this protection also extends to them attempting to reduce you for failure to report for an exam. P&T and age 55 does not prevent the VA from scheduling exams although the regulation generally states they will not be scheduled, but if for some reason they think you are better they can. A rating that has been held longer than 5 years cannot be reduced on the results of just one exam, furthermore, the exam needs to be as complete as the exam that granted the rating. The 5 year rule does not prevent the VA reducing a rating due to a no-show on a re-exam.
