Hypertension...is This Enough To Win A Claim

Question

My initital entry test for bp was 118/57 in 1998

Dec 3 1999 my bp was 161/65

Dec 27 1999 my bp was 171/67

May 5 2000 my by was 164/66

May 14 2000 my bp was 167/70

There was no prior high bp prior to military service

I am currently prescribed medication by the vs and my personal Dr. For high bloop pressure.

Is this e bough for compensation at 10%

Hollis, what were your original rating BP readings on your award letter?

If they were high like the ones you posted, you may have a cue based on the following.

Cue is a legal error; The Error is a mis-application of the rating schedule in order to pay you a lower amount than the schedule lists.

Your Harm is that they harmed you by shorting you money.

This would qualify as an undebateable error because reasonable minds would pick up on this as a cue.

It all depends on your earlier readings.

hollis surely you must have ED as well with bp readings like that. have you filed?

those reading was the my first day at the VA to see my assigned Dr. My BP was so high on the first reading I had to sit there for about 30 minutes , they again took my BP and it was still high, but not as high as the first reading. At the ending of the meeting I had high blood pressure medications my hands. When I doing the C&P I told the Dr. that I was on BP meds from the VA, my reading was 155/112, they had to do it 2 times to see if they had it correct. that is where I got 0%.

I guess I was to embarrassed to admit that I do have ED. I have not filed on that

My BP is now running between 140/78 to 158/82 , but this is under two different medications.

I have another nuclear stress test coming in March, will wait and see how that goes, last was a surprise to me, I had 95% blockage and had no problems indicating I had this blockage. I will keep everyone posted on here, and thanks for the advice I have gotten

I would wait until your current claims are completed. In the mean time, obtain an appointment with your doctor and tell him/her that you have ED and you believe it's due to the meds. Let the doc obtain the diagnosis. Once your diagnosed and it's in your records and your current claims are completed, submit for ED on a VA FM 21-526ez, Submit your medical diagnosis with the form. Unles your doc is with the va, then you just need to submit the form. The va will canvas its own records.

When you are service connected for ED the VA will award you a 0% but you will be paid a SMC K which pays somewhere around $105.00 a month.
