Bva Decision Now Remand, How To Track

Question

All,

So i got my long awaited decision on 1-17-2014.

It said it was being Remanded back to the Cleveland Ohio RO.

What happens next?

Any way to track the progress of this?

Average wait time (any guess helps)?

Im talking with my attorney on wed. Seriously thinking i should just ask him to file the unemployeability thing.

Yes i am at 70%. How long does that process take.

I guess im trying to figure out the lesser of 2 evils here.

Please advise.

Depending on what the BVA directs in the remand, any number of things could happen. If you post the directions of the remand, others will help you understand what is about to happen. In my case, the hearing was last January (around the second week). The remand was issued in March/April. Ebenefits showed another appeal as the remand directed that an older appeal I had dropped get reviewed by a DRO. I had a C&P last Sept 2013 and TODAY noticed the extra appeal was closed and dispatched. In this case, the VARO followed the direction, re-examined me, and has now revised the decision. I'll see what this means in the next few days.

The other items in the remand have yet to be addressed. Still no new C&P as was directed. My rep told me the new items were only entered into the system in August 2013 so I should be getting scheduled for another C&P. I expect the next issues should have motion within the next few months. This is only my personal experience, though. Without seeing your remand, there's no way to know.

They are supposed to follow the instructions in the remand.

Not accurately - you just remain in a holding pattern.

6 months - 2 years - jmho

It will go in as a new claim issue - 6 months - 3 years - jmho

Perhaps they will consider IU during the remand process, but they will

still want a signed copy of the IU form.
