Dead Veteran Set For C & P Exam

Question

The Buffalo VARO sent my c file on Sept 23rd to the Bath VAMC to have the veteran obtain a C & P exam.

He has been dead for 11 years!

I can hardly believe this-

wait a minute- yes I can-----

I think I better get over there to the VAMC and see how this will be done.

Is this ridiculous or what?

Maybe they could exume him? The VA is probably the only idiots who would argue whether or not a Veteran has been dead for 11 years.

he's not dead until the C&P doc says he's dead. knew it was only a matter of time before they started arguing that point,,,,,,,,,, Berta do you still have the urn? I would make sure he showed up for the exam.

I sent some of Rod's ashes to the VARO long ago as evidence in response to some idiotic medical statement they put in an SOC.

My vet rep from Buffalo justed called me- this is being squared away.

I filed additional service complaint with the VA just to be sure-

My vet rep feels that I have definitely put my claim into Relative Equipoise already- when you have two good IMOs (one from a treating VA doctor)and the VA has Nada- that is the Benefit of Doubt Doctrine-

but only another VA doctor's opinion at this point

seems to be the answer and they assured me it is going to a specialist.

I reminded my vet rep- yes I have already tipped the scales in my favor- as he agreed- and the fact that NO one at VA medically diagnosed and treated Rod properly (documented FTCA settlement and 1151 award)in 6 years would indicate a negative medical opinion from some VA specialist would be in the same category of the quack stuff

that Rod's med recs are full of.

I would slap that down with another IMO-

My vet rep and I went over the critical evidence-it actually is one single med rec which will win this claim.That is all I ever needed. I am fully confident I will succeed.

Of course- that is if the VA does drive me completely nuts first.

Berta you will win cause its just your incredible fortitude. I am so impressed with how far you have come since we met on Prodigy.

Quite a journey from someone who did not have a clue to an expert. But you were like many when you started including me. I did not know why but I knew that the VA was wrong about my claim. Than you found out and beat them at their own game.

Dont suppose that someone in finance has been posting debits for his account to some unknown bank account? :unsure:

Naa no VA employee in finance, especially Austin Texas would ever do that!!

Must be a "clerical" error.. :rolleyes:
