rod
The regional office keeps saying "next" week the peer review should be done. They've said it for over 2 months. Should I be concerned with the delays?
0 Moderator broncovet Posted October 22, 2015 Moderator Share Posted October 22, 2015 Well, Im not sure in what context you are referring to a "peer review". Im also not suprised that VA did not get something done when they said. Peer review generally refers to one employee being "reviewed" by others. So, Im not sure what that has to do with Veterans. Unless you are a VA employee, you dont have much to conern yourself with employee performance reviews. If you are referring to a "peer review" of your claim, then its probably a good thing. They never review denials, ever. Its only awards that are ever reviewed, and large ones at that.
0 Berta
This type of peer review is done by VA for FTCA issues.VA claimed they did about 5 Peer Reviews on my SF 95 charges. The initial Peer Review "disappeared" because it was completely supportive of my SF 95 .I found it 8 years later. That is why FTCAers need lawyers...so that kind of BS does not occur. 0 rod
Thank you Berta. That's what I was afraid of. Getting multiple peer reviews until they find one that sipports their defense

0 rod
Surprise surprise. 2 days before the 6 month time to investigate my FTCA claim the VA attorney contacted me this morning. She said she recieved their peer review last Thursday. She wants to know in addition to my pain and suffering was there any other losses such as lost wages or medical bills. 0 Berta
It sounds to me like they want to settle with you.The VA attorney called me too when he got the Cardio Peer Review results and he told me right away it supported my charges.

Thank you Berta. The Malpractice occured in South Dakota. South Dakota has non-economic damages capped at $500,000. I've seen the ridiculously low amounts widows have settled wrongful death cases. Ea
