Question on CH 35

Question

I'm 100% total and permanently disabled. I received the disability rating 6 years ago, and my then (now ex) wife used Chapter 35 education benefits for 2 years before we divorced.

I recently remarried and want to know if my (new) wife is eligible for ch 35 benefits? And her children upon turning 18 (not my biological children)?

It has all been within 10 years or should this not even be a concern?

Thank you all in advance.

The regs include "step-children".

I don't think your limited to 10 years.  I think that each eligible person has ten years.

And the VA will extend the Entitlement date with proof of service if the 'child' is also a veteran.

Also, in my case, VA awarded entitlement based on a posthumous 100% P & T award for my husband, but when I succeed in my AO DMII death claim, they extended my EED for Chapter 35 entitlement again, paying retro for the courses I took after my Champ 35 original EED ran out.
