Re-Evaluated claim

Question

What  can one do if the VA Dr. made statements that I never said? This is very concerning to me to read the evaluation and to see the Dr. flat out lie and state word for word that I said something that I never said!

I guess it would depend on the circumstances and what actually made it into your results. The most common example of examiners not being accurate is when they ask how you are today and you reply, "I'm fine." Yes, they may take you literally, so be honest, not blindly courteous. If you feel like the floor of a taxicab, tell them.

I would confront this Dr and ask him why he mention things that was not said in your evaluation to you? Ask for an Addendum/Amendment

Now with that said  the Dr's/PA's ,L.C.S.W. have to make a written report on there findings with you After the evaluation/exam.

Yes buck this was clearly a C&P set up by the VA to reduce my IBS. I am at maximum for that claim so the Doctor clearly is trying to say that I should be reduced by stating things I never said and if I said what this Doctor said then it would be basically asking the VA to reduce my claim. Wtf like I am going to do that. I will take this all to my VSO if I am denied. He is very helpful.

I can tell you this Doctor made two specific comments quoting word for word things I never said, that is a blatant lie. I am going to call him on it that is for sure. If I am reduced im going to my VSO and going after this Doctor's throat. This is the same Doctor that gave me a shitty C&P years ago when I was initially denied.

I would do it before your denied  if your denied?

you might not be denied  b/c they may just make you the same as you are now ..Although  the Increase could be denied but thats a hell of a lot better than a Reduction.

But if it is the cause of your denial (VA C&P Dr) then I'd try to set the record straight  and maybe go get an IMO as new evidence and make sure you use a specialist using the VA guidelines that will give a better detail impression of your disability than the VA Doc as to rather or not it is the same or as in fact  got worse opine by medical  specialist  for evidence of  exam and reading of pertinent medical records to this claim by the specialist.
