C-File, does RO's claims specialist opinion / interpretation of evidence, appear in C-File?

Hi Berta,

Thank you so much for that link.  There is a screening that will be close to us! I am making an appointment for hubby!! 

As of TODAY, still haven't gotten the decision letter, explaining "HOW IN THE WORLD" they rated him at *10%* but that in the dollar amount they deposited into our bank, back to the date of the initial intent. 

Like I posted the picture (above), hubby's private medical doctor has on TWO 'VA' forms stated his MET's are 1-3.  My hubby is basically sedentary.  (and that is noted in the documents given to the VA).  Yes, he as PAD, Peripheral Neuropathy, CAD, COPD and also noted was the heart attack he had 2004, and the recent stent 2017 in his leg.  All of that information regarding his heart condition was given to VA.  I MADE SURE OF THAT!!  I mean he is "70" years old....how long do they want him to wait??  WTF??  

I don't know how they could have OVERLOOKED all that info!  You are SSSOOO right.  His ejection fraction did get better...but his MET's have gotten worse since his heart attack.   I am sure that is all they looked at was his ejection fraction: 55%...NOT ALL THE DOCUMENTS I submitted.

WOW- that is why I mentioned the "or" part of the regulation.

I need to find the site link---couldn't hear him say it...and maybe he should be conctacted by the Podcast people to do a radio show here at hadit.

I have never heard of him before.........

We can review the decision when it comes to see what they did right and what they probably did wrong!

The decision mught contain a CUE.... hard to know yet----andf maybe could a get a faster resolve if they did make a CUE.

This attorney said what I have said here too, many times, the error might be a simple error they can fix  because they didn't read the regulation correctly,

or it was Intentional. Which I think most VA errors are......

MKAH, depending on where you're at in your SC Claims and Appeal journey could dictate the need to file a VA FOIA for your Complete C-File. You, reviewing your complete C-File on CD (if over 10 pages) is the only way you could be certain what is actually in it. Took me 8 mos to recently receive my CD  after filing the FOIA.

If your question is in regards to a recent Claim Award/Denial Decision, your POA VSR has computer access to your C-File and could pull up and print the respective pages.

If you weren't opposed to spending some (few hrs min) time at your RO, you could contact the RO by phone or mail to make an appointment to view and print portions of your C-File. The VA Reps on the 800 help-line will tell you that you don't need an appointment to view, just walk-in; 1st come 1st served. I Tried that at the Det RO, didn't work. I hate to say it, but it makes sense. The VA RO has to schedule an Employee to accompany you while you view your C-File (actually E -File) on a computer and authorize whatever pages you want copied.

RIGHT! I put in a FOIA request 3 months ago! Still waiting! 

My hubby started receiving his benefits $$ but has YET to receive his decision letter. (How a$$ backwards is that?) I don't know if his PA VSO has that letter. I thought I'd wait to contact him before I knew what I was talking about, but maybe he has access to that too!

I have watched many of his YouTube clips and find them to be helpful. Talks A LOT about what is said or asked about on here! Hope he becomes a member. 

I sent an email to them about that very question (The "AND"  - OR") law clause, and they have called me on the phone, but I missed the call. They left a message. I may call them back "AFTER" I receive hubby's decision letter. 

We have had the award $$ for a week now...(@10%), but STILL no idea HOW they arrived at that conclusion!! Uuugggg!!
