I got mine free at a gate to one of the National Parks on a trip through them with my grandchildren the year before COVID by just showing my VA ID. Good for the whole vehicle which was a motor home then. Teton, Yellowstone, the Monuments, Devils Tower, Rushmore, and more.

The Park one cost $10 for a lifetime card. I just got one.

instead of focusing so much on the DBQ you need to have your lawyer look at the exam request itself because within that is the question or questions that are being asked by the rater, which would then be the driver for the new C&P exam. The DBQ‘s may look to be complete, but I see DBQ‘s sometimes that are full of all kinds of things written down as rationale, or citations for medical documents or reports or studies, and other things, but none of it actually addresses what was asked. Kind of like those term papers you write in college every now and then after you’ve had a bad weekend and there’s something due on Monday. You throw literally everything you can add to it and hope that the instructor gets lost in the details without seeing the whole picture, and the simplicity of what was actually being asked. I see this a lot with the swampy type of lawyer firms that basically upfront promise to increase your rating by X etc., etc. and then the documentation that they provide to the ratings people is full of all sorts of legalese and half theories and generally rubberstamp opinions from examiners that they have agreements with or relationships with, but none of it necessarily matches up completely with your service treatment records or your personnel records. The opinions being made are not supported with a decent rationale or citation of the medical records as to why that opinion is being made by the examiner, it just sort of comes out of nowhere.

The VA is required to maximize your benefits. For example, you file a claim for SC neuropathy on you right leg. In the process the VA find out that you have a back a SC back issue that is causing the neuropathy. The VA has a duty to maximize your benefits by seeing if you back condition is. 1. service connected. 2. If so, do the need to SC the condition as secondary to your back and rate the back.

It's ok to vent a little. First let me address the Remanded to RO. When the VA rated me for my PTSD. (It was on a remand) The decision letter from the BVA should list the reason why they are remanding it to the RO. (Someone did not answer the questions right. Or they need more information) In my case I did 2 C & P Exams and a third was requested for a independent medical opinion, (IMO) from the same doc. Maybe brokensoldger244 can add to this but I have been told by the VA if your claim fits certain criteria the system will automatedly request a C & P Exam. I don't know about the acracy to this I will see if I can get him to give some input hear. To answer your question about, "Fishing for someone to disagree with doctors who have been treating me since 2010 and the doc from last C&P so they can deny?" This does happen more than anyone admits to it. If you can catch them in it the following does apply. -VA cannot "develop to deny" a claim. Since I have already submitted a complete package of private evidence, any further development with C&Ps would violate VA policy: "Decision makers may not arbitrarily or capriciously refuse to assign weight to a claimant's evidence or develop with the purpose of obtaining evidence to justify a denial of the claim" (M21-1 Vii..3.B.1.a). This prohibition was emphasized in a law review article published by the BVA: "additional evidence should not be procured for the sole purpose of denying the veteran's claim" (1 Veterans L Rev. 94 (2009)). Even CAVC has strongly affirmed this policy: "Because it would not be permissible for VA to undertake such additional development if a purpose was to obtain evidence against an appellant's case, VA must provide an adequate statement of reasons or bases for its decision to pursue further development where such development reasonably could be construed as obtaining additional evidence for that purpose" (Mariano v Frincipi, 17 Vet. App. 312 (2003)).

I think I was clear, when the regional office denies a veteran’s service connection and the veteran appeals to the BVA. It is very normal for the BVA to only address the issue of service connection. After granting service connection the BVA will then remand the appeal back to the regional office for them to assign it a rating percentage and an effective date. If the veteran disagrees with either the rating percentage and or the assigned effective date, then the veteran would have to file a new appeal back to the BVA. It is what some of us call the hamster wheel, back and forth from the regional office to the BVA and sometimes the CAVC get caught up in this cycle if the BVA denies a veteran’s claim/appeal and the CAVC would/could approve a remand to the BVA and from the BVA to the regional office.

So, to answer your question the decision letters stated the following. 20 percent 20 percent 70 percent 50 percent 30 percent 10 percent This give you an actual combined value of your disability ratings is 95%. Round up to the nearest number it will equal to 100% Schedler rating regardless of if they have ratted you 100% UI T & P. When they remand a claim, it is for further development. This could be for some question that the BVA needs answered or an error in how the RO applied the law in your claim. the BVA may need an updated C&P exam because you stated you had one earlier. Did you get a letter from the BVA? It should state in it what the remand was for.

I totally agree with Vync. I have been treated for pain at the VA for over 20 years. The VA has steadily reduced my pain meds with zero other realistic options for pain control. They gave me anti-depressants. I suffer pain and it has nothing to do with psychological issues. The whole thing is the VA is scared of the DEA. When in doubt throw the vets under the bus.

Hill & Ponton as well as Jan Dils both told me to xxxx off. Apparently, if you are able to work and your rating is just a little too high, they don’t want to take you because your backpay will not be high enough, and it’s not worth their time. This is three in a row, who decided not to help me because I can’t make them enough money. I would really appreciate any recommendations or referrals. I know the market was flooded in the past several years with many lawyers who decided to focus on VA claims because they were making money, but this is a little ridiculous They all pretend they want to help veterans, but we are just a means to an end for them.

I get your frustration. I had several DBQ's done outside the VA (no lawyer, because I was pretty versed in the CFR). My DBQ's were way better and more thorough than any of the VA DBQ exams. One of my examiners was a former QTC guy with over 20,000 exams to his resume. The other was a QTC DBQ instructor. Kind of knows what they are doing so to say, yet they asked for additional C&P's. I pissed off one QTC examiner with these outside exams. She did a hack job C&P exam to counter mine. I reported it to the VARO. Got several more VA exams and ultimately threw the hack job exam out. I wouldn't throw your outside exams in their face, it irritates them. Just go through with them and let your lawyer do his job.

Otrgypsy, If you are being paid at 100% regardless of rating the most important is the T&P. Total and Permanent is the indicator that you are considered Totally and Permanently 100% Disabled - Relax and enjoy your reward!

So, about veterans and passports... From what I've gathered, veterans rated at 100% are usually eligible for a free passport. It's a small token of appreciation for their service.

I have a couple of questions on the ptsd claim/award. When was the original claim submitted and was it under active appeal since that original claim date, when you were awarded the 70%? Just curious if your ptsd claim was prior to any VA rule changing. thx

@FloridaNative I can definitely sympathize with your situation. Around 2011 was a big push to get marijuana legalized. The FDA suddenly changed their guidelines for prescribing opiates. Almost overnight, the VA docs began refusing to issue or renew opiate prescriptions without a lot of headache and outright refusals. The VA medical centers had a "VA patients bill of rights" posted all over their facilities. With it was a right to have your pain treated. That section seemed to disappear for a while. However, it is back as of checking this morning at https://www.va.gov/health/rights/patientrights.asp That sounds promising, but it has became increasingly more difficult to get effective pain treatment lately. And what works for one vet might not work for another.

Since you posted you are 100 percent plus SMC S and SMC K, the only way for an increase is an increase in SMC. The only reason I file for an increase is in the event it could result in additional compensation or additional compensation for my family. For me, I dont need to add a bunch more disabilities to a list which do not provide additional compensation for myself of my family. Its unclear to me how any of those disabilites you mentioned, except PN have any chance of additional ratings. PN "may" lead to a loss of use, tho I really could not give an example of that happening. And, SC for PN could result in needing A and A, if the other disabilities did not already do so. DAre you getting A and A, or do you feel the need for same? If so, you should have included that. As far as "not applying" for SMC K, you should not have to. SMC are generally inferred, and the VA is supposed to award them "when you meet the criteria". Its certainly ok, or even a good idea to apply, if you think you deserve higher levels of SMC which I guess I will assume you are going for. In the light of the above, my suggestion would have been to focus on applying for things which have a good chance of an increase including PN, loss of use, and/or A and A, as these may apply. Bloodwork, I may specualte, may be necessary for an increase of DM, if your A1C is significantly higher than when you were rated for it. Also, for other conditions as a doctor may diagnose. Its not unusual for doctors to order blood tests, even when we dont see a need for them. I guess you could try to go to medical school if you really want those answers, because conditions of the blood may well help diagnose other disorders, to include PN. However, IM not a doctor, so Im not qualified to answer that question, its mere speculation on my part. My advice would be to attend to the c and p exams, submit to the bloodwork, and probably add any of the issues I mentioned above to your claim. (Such as A and A, if you need it, loss of use, if you have it) As an example, if you cant use your feet because of the PN, you may add loss of use of your feet to the claim. Finally, even if its your spouse or other family member who provides A and A, I would advise applying for it. The regulation specifically provides that you can still get compensated for A and A, "even if" its provided by a family member. So, if your wife cooks for you, helps you put on your socks and shoes because of your PN, helps you get in and out of the shower, does all the shopping and housecleaning, including laundry, and takes care of home maintenance, and you can not dirve, for example, so your wife must run all errands such as take you to the doctor, then you may qualify for A and A. I could have provided links, such as the regulation which demonstrates that you can still get a and a even when providend by a relative, as well as application forms for A and A, but you seem to know your way around. I have filed supplemental claims for several conditions because the VA left the ratings the same when established in 2011, and most are related to Parkinson's Disease and worsening. I was notified by QTC that I have a few exams, but not understanding why? I am 100% P and T with SMC-S and SMC-K One they are doing Male Reproductive DBQ secondary to DM II Agent Orange. I have been SMC-K continuous since May 2001, and held a DM II rating since January 1998. I claimed Chronic Fatigue (heard nothing since July 2023, diagnosed and meet the 60% criteria) , PN they failed to examine my feet. Restless Leg Syndrome the VA states is related to PN, although they are two unrelated conditions. PN is generally caused by DMII, and is problematic 24/7; with RLS only occuring at night when sleeping, and in my case caused by Parkinson's Disease. Why is the VA scheduling me for blood work as part of the claim process? My ratings areas follows, and continuous: 70% PTSD rated 2001 20 year rule 70% Combined for Parkinson's Disease (Agent Orange) 2011 40% Right upper rigidity/tremors 2011 30% Left upper rigidity/tremors 2011 30% IBS 2023 10% Facial masking with Ptosis 2011 10% Balance problems 2011 10% Difficulty swallowing 2011 60% Urinary dysfunction and urgency 2023 60% Nephropathy (Kidney Disease secondary to Agent Orange DM II) 2011 50% OSA 2024 30% Acne (Agent Orange) rated 2001 - 20 year rule 20% DM II (Agent Orange) rated 1998 - 20 year rule 20% PN lower right extremity 2011 20% PN lower left extremity 2011 10% Shell fragmentation wounds rate 1979 - 20 year rule Several 0% ratings Comments as to what is up concerning a possible reason for a DBQ for ED (already SMC-K for 23 years) , DBQ for DM II (rated in 1998) would be appreciated. I did not claim either of these two contentions.

There is a problem with pain level reporting. I first define my pain level. And how long I can go with it without committing suicide for relief. I have to explain that depression is used to suppress the pain level which means my face does not show it the way the addicts fake it to work them for meds. 5 continuous for weeks is enough to drive you over the edge from there it only shortens the time before you are looking for that finale exit. Fortunately for me, Keppra, my seizure medication enhances my pain medication as well as reducing pain. I have not had a level 5 since I began taking more than twice. The longest lasting once was when I fell and fractured my knee cap. It took a day before I started feeling the fracture pain and because it was a broken bone, I got more than I needed. I will have to throw the left over away in another year or so. As the suicide rate rises again, there will be a new look at whether it is better to occasionally give an addict his fix rather than miss someone who really need the pain med. Yes the problem with back pain is that the source is not always seen on radiographic reports. I have MRI reports two weeks apart on my neck. The one done by a resident in training and signed off by his supervisor showed a lot of stenosis as the source of my pain. The other, read by a VA contractor showed no stenosis on an MRI of the neck by a different VA only a week later because the neurosurgeon wanted his on MRI to look at and the earlier one was not in the record yet. The problem with the readings may only be how much the two different sources pay for their software. The better the software the more you can see. In Japan the software is Nationalized. The research is done at state Universities. And every level of physician has the best software. Not so here in the land of the big Px. Most clinics cannot afford the best and the only time you get the best reading is if you go to a VA that works in association with a land grant university medical school.

You do NOT have to have a diagnosis of sleep apnea in service to get service connection for sleep apnea from service. Instead, there are at least 2 ways to get service connected for sleep apnea. 1. (Secondary Service connection) Be service connected for "something else" (often a mental health disorder such as PTSD or MDD) HAVE A DIAGNOSIS OF OSA, and be using a cpap AND: Have a nexus letter from a doctor that states your current diagnosis of sleep apnea is at least as likely as not related to your PTSD (service connected). (And explain why the doc thinks so). OR 2. (Direct or primary service connection) Have the 3 Caluza elements of: A. CURRENT diagnosis (not necessarily an in service diagnosis) B. HAVE A DOCUMENTED "EVENT IN SERVICE" C. HAVE A DOCTORS NEXUS, WHERE HE SAYS YOUR CURRENT DIAGNOSIS IS AT LEAST AS LIKELY AS NOT RELATED TO YOUR "EVENT IN SERVICE". WITH SLEEP APNEA, IT COULD BE A FACE INJURY, SUCH AS BEING PUNCHED, OR DIVING INJURY, SUCH AS HITTING YOUR NOSE HARD DIVING INTO A POOL., OR OTHER injuries which may have fractured your nose/face. It could be related to a mental health disorder, or obesity, or, as a doctor so decides. None of the above requires an "iN service" diagnosis". Altho an in service diagnosis of OSA would be helpful, it is not necessarily required. Many people have OSA and dont know it. You could even have a clean exit physical and still have OSA because, they may not know it UNLESS they gave you a sleep study, and they rarely do that unless they have a reason to think you may have OSA.

As explained above, if one or more VA employees/providers wrote down the incorrect pain level, then you could/should have it corrected. Its my opinion you are better off not to "attack" the individual involved, but instead simply explain that you did not make yourself clear; your pain level was a level xx not a level a, as indicated by the medical records. The pain level, is a level judged "by you", not by others.
