ALL VA correspondence is logged and recorded you can access in your c-file, sometimes if the VA mails to the wrong address the date for appeal is still open. my argument rests on 1) the VA never properly evaluated me for TDIU, they also never sent me a form 21-8940. 2) they never denied me TDIU, they just said that I was not eligible because I did not have a SC that was 60%, all because they proposed to reduce. I was 70% PTSD, they never reduced me, My PTSD effective date is 3/2005. The VA had to evaluate my claim for TDIU because I was eligible, and they had knowledge of my

  2. also , VA will no longer presume a claim for TDIU is a claim for increase in all service-connected disabilities. this was the ruling to force veterans to select a specific service connected disability for a tdiu claim. before this you were able to claim tdiu for several service connection. once the VA has evidence that a veteran is unemployable due to a service connected disability, the VA MUST send a form 8940, even if they deny it 99% of the Time

  3. J2, if the wheels fall off your car, the buses aren't running, Uber's shut down, you could go on your e-Ben site and file the Increase FDC today. Just logging in and beginning the CLAIM would get you in under the 06/01/2018 Filing Wire. If you don't have access to your E-Ben site, for whatever reason, just call your POA-VSO and request that they File for The Increase this afternoon, you don't have to be there, that's what the POA is all about.

  4. Berta, thanks for the reaffirmation and offer of help. I will certainly do as you suggest. I'm a little torn between gratitude of the VA (My Country) with my disappointment with their process and systemic shortcomings. That they will compensate me for my service maladies takes precedent. I don't want to come away from this challenge looking mercenary or a gold-digger. Regrettably, I think the folks working the processes will think that way regardless of the validity of my claim.   5. asknod, first of all...thanks for responding to my post. Para (1) - Not only should the evidence have been in my file, I referenced it in my reconsideration request. I have my C-file, but it is not up to date. Para (2) - Understood. Para (3) - Understood Para (4) - Yes, I may have been acting a bit timid. I figured the truth would have prevailrd. I never expected the VA raters to act like aggressive District Attorney, seeking a conviction regardless of truth. In this case, someone completely lacking integrity. And, I'm disappointed with a VSO that either takes the path of
