  1. Sounds like you are on the right track. Now remember after they fix it they can drop it to zero if there is no Pain/Tenderness/Unstable scaring. I have had many issues with mine after the surgery like loss of feeling in the area. Sharp pains at certain times when walking. Change in weather. Just make sure when they bring this up that they know all the issues you are having with it, if there are none then they did an amazing job! If it is SC then the VA will cover it.

  2. Some C&P exams can get really messed up. I had a NP state I was taking morphine and hydrocodone for headaches, they weren't prostrating and only lasted a couple of minutes. She totally screwed the C&P up. My neck and back (basically the whole spine) is my problem, not headaches. Keep fighting. What you have written sounds good for your case.

  4. OverMuch Your rating is not static, which means you are subject to "regular" re-evals. Nothing unusual and you should be alright provided you have been seeking treatment and seeking regular medical assistance. If you haven't been going to the VA but your own MH doctors, bring evidence and updates if you have any from your current docs with you. They may not look at them but if you have ebenefits, you should upload that info into the system; otherwise, how is the VA going to know? Since you went from 10% to 90%, that was a steep hike and they just want to be sure your symptoms haven't changed

  5. @sailorgirl80 Im so sorry that what happened to you happened. I have no MST claim experience but I just had my claim close that i submitted back in April, C&P's in May & June for a MH related issue. I also second @broncovetadvice here. Theres a reason that there are multiple cliche sayings like "a watched pot never boils" and its especially true with VA claims. I dont always follow my own advice, but checking1,2,3 times a day on ebenefits will drive you crazy. Set a specific day of the week you will check ebenefits and stick to that schedule. Also while the money from a

  6. Congrats to your retirement and you are one of the few to get out with 90%. I only got 10 when I had retired. My question is, when you filed your claim for your back, did you file for sciatica and radiculopathy? Are you still in that 1 year window for an appeal? Did the C&P examiner use the Goniometer? The reason why I am asking is because looks like you have only been rated for the range of motion. If you are within that 1 year for the appeal and have new and material evidence, you might want to challenge it. You need to get a copy of that C&P exam and study it very well. Sa

  8. Kanenut -that is WOINDERFUL , and of course the decision might contain errors- I saved it to go over later today as weather is affecting my Sat. Dish.... I said to you here some time ago that YOU should be a LAWYER!!!!!! Thank you !!!!!! for being so willing to hang in there with this claim. And so willing to educate yourself on VA case law and regs ( you even know many aspects of M21-1MR-which alludes many VSOs, vet reps, agents and even vet lawyers.) Although the BVA is not "bound" by M21-1MR they have made many remands and made other legal statements in their decisions t

  9. Congratulations! I agree with Buck, but will add: Be sure and check the effective dates, and make sure they are consitent with YOUR records. You may need to appeal this decision to get an EED, if you deserve one. (VA LOVES to hornswaggle Vets on the effective date). But, dont forget your other 100 percent P and T benefits (Some of these may have time limits or you lose). 1. VA life insurance. 10,000 free (waiver of premium). Dont even think of skipping this one, its whole life insurance and builds up cash you can access later. 2. Champva for your spouse.

  10. Take your award letter and the commissary letter being IU your considered to be a 100% veteran the 90% is just for compensation purposes. I took the benefits letter that showed I was 90% but being paid at the 100% rate due to the TDIU P&T THE APPRAISAL OFFICE TOOK IT AND YOU MIGHT WANT TO ASK YOUR APPRAISAL OFFICE IF THEY CAN GO BACK 2 YEARS FOR YOUR PROPERTY.TAX AND SCHOOL TAX RETRO BACK TO THE DATE YOU WON THE TDIU P&T ON THE PROPERTY TAX YOU PAIN IN. BUT DIFFERENT STATES HAVE DIFFERENT GUIDELINES SET. IU VETERANS AND 100%SCHEDULER VETERANS ARE EXEMPT FROM THE PR

  11. I went through the same hoops but of course I was 0 percent for 8 years before they made me 50% by going to my LHI appointment and not getting my appointment together with my TbI residuals. At least they ordered a second one that was my good sign....

  12. First, the 2018 C & P exam in way to old. Second, it seems that you filed a claim, and it was rated and denied in Jan 2020. You recently filed a supplemental with new medical evidence Nov 2020 and VA has scheduled you for a new C & P exam. It is normal for VA to schedule a new/current C & P exam prior to making a new decision. This is a good thing.

  13. blah I know one thing. If you are not comfortable with a VSO, move on brother. Your intuition is important. You go the way HE wants to go, and it doesn't work out. Who do you blame? Get someone you can trust. If you have different opinions on how to go, that's ok as long as you end up comfortable in going the final direction. If you can't get there, why struggle. Get a new VSO. Or, do it yourself.

  14. gumba88 You wrote... I believe you have two things going on. First, you used "Vet Rep", probably a VSO correct? Possibly from the VFW, Am. Legion, etc and he refused to submit? But it really wasn't a VA employee who refused correct? They can't do that! The VSO from a service organization can attempt to convince you that it won't work, but a VA Direct can't. Now, what I would do, and this has to be in your make-up, not everyone would do this. I would wait for the the decision letter to be official, and then I would take a redacted copy and make an appointment with the supervisor/

  15. It's been a very long wait for myself personally but I am so thankful to TBird for starting hadit & Pete53, Berta & the countless others of members whom make up the knowledge base in which we thrive to combat the injustice we face as veterans. I've been so skittish about this even now posting an update to you all as if it were going to reverse my decision lol & then I remembered wait your always thanking everyone for sharing & their service so be that same person in this situation. Wednesday afternoon I was sitting home with the kids right after breakfast I got a call on my i
