Third, I really appreciate what your website is all about. I think all do. I have contributed, as well as many others. But when you added ads, this has literally overtaken the site. It's a nightmare to maneuver now. I tapped on your profile and got a page covering 90% of it with ads. I don't know the best solution but this is not what it used to be. It would sure be nice to get back to normal if anyone can help provide some ideas. Otherwise It's my bet that member churn will cause many to leave.

I am looking for help...what is the interpretation of this policy by my previous employer: (VA medical center.
d. It should be noted that if an employee is no longer qualified or able to perform the essential functions of the job, VA is not ordinarily absolved of the duty to provide reasonable accommodation.
I am trying to justify that the accommodations provided to me were not reasonable accommodations and I was in a "protected environment" during the last years of my employment Provisions made were:
1.Permanent change of shift until my retirement, not availed to anybody.
2. Hired another staff( undue cost) to perform the essential part of my job(Lifting and positioning patients)
3. Let me sleep and let me go home without charging me leave. Any clarification to what it means is appreciated. Thanks

Hey, I got a question. Do you know if you can get aid and attendance (Special Monthly Compensation L&1/2) for PTSD and hold a job? Currently at 100 Permanent and Total plus Special Monthly Compensation S for having a condition at 60%. Personally, don't have a job yet. Failed out of voc rehab twice, trying for a 3rd. Even then, I'm going to need to accomodations. Trying to work as a nurse for the VA. Got a long road ahead of me. What do you think?

Hello Ms. Berta,
This is my first day being registered and posting. I would appreciate information on the following.
I have been accepted into a residential program in Bay Pines for Military Sexual Trauma (MST) - PTSD treatment. Question is, can I receive Financial Compensation (for having no income coming in for 4-8 weeks) while in the program? I am not SC yet although DAV has helped me submit a claim. I was told by the MH provider when the consult was submitted, there maybe a possibility that I can receive Financial Compensation (for having no income coming in for 4-8 weeks) while in the program. I have not been able to confirm this. I am wondering if you have any info on this.

It was great that you did that for the July list and saved MUCH time for all who needed to find their ships.
Kurt's wife will try to listen to the archived radio show Kurt did----tomorrow night here.
He helped SO many and we were fortunate to have him as a member. He stopped helping with claims because his disabilities got worse and worse.
But his work will continue to help Thailand vets and Any veteran who was exposed to AO, anywhere, who can prove their exposure , via their MOS and their installations use of AO and who has an AO presumptive.Like the two AO CONUS vets did.

Hello Berta. I was seeking you knowledge and advice on my current claim. I conducted a video conference with a law judge on October 11th, 2019. I am seeking a claim for chronic idiopathic urticaria(hives) that I've been battling for close to 28 years. I conducted (2) Persian Gulf War clinical studies and evaluations at Walter Reed back in the early 90's. The file acknowledges that I have this chronic illness but I lack a nexus letter or imo. The judge found my testimony to be very credible and identified a treatment for dermatitis while I was in service. I also sought medical treatment on the private side, Dermatologist, immunologist, and internist, with the same chronic idiopathic classification. I am looking to associate my illness to the toxic exposures and/or the initial dermatitis diagnosis that I received while in Iraq, Saudia Arabia and Kuwait. I've been given 90 days to get a imo/nexus letter from a dermatologist. Essentially my question is do you know of a regional resource that would identify a good starting point for locating a Dermatologist who could assist with such a letter? Any other points of advice? Could medical hypothesis's be helpful?

I need some solid advice from you hardcore VETERANS...Exactly what avenue should we take to get compensated for our service related sickness/injuries when medical records not on file? We searched high and low, every duty stations and hospitals to include initial home of records VA offices and hospitals...Seems like no one cares, they just keep denying our claims in hope that we DIE(truth)be told.

I need your assistance on drafting up my NOD for my clothing allowance denial letter. I have pdf my clothing allowance denying my Lower Back Pain Brace redacting personal info. But, I have to ask for assistance first. I have done my research per to the requirements of the Website, and don't want to hijack other members post. I humbly request your guidance.
History/Summary:
The VA Prosthetic's sent me a denial letter saying that my Lower Back Pain (LBP) Brace isn't on the list of approved devices.
I have been receiving clothing allowance since I have filled. I've always been fitted for my LBP Brace, and always received a rigid back brace that has two parts. Then one day I went to the brace shop to get fitted and was informed that the individual who does the LBP Brace fitting wasn't working. I left and 2 days later I received a brace in the mail from the VA Prosthetics. The New Brace they sent me was much smaller and it's a one piece LBP Brace. I said to self well try it out, I liked that it was not as bulky as the 2 piece LBP Brace I have been receiving. Tried it and noticed that it wasn't supporting the region of my Back where I have alot of pain. I tried this for a year and then I informed my Primary Care Provider about the New LBP Brace wasn't adequate. My Provider gave another consult to go to Prosthetic's to get fitted. And the same thing happened. Prosthetic's informed me that the Brace fitter guy was in a meeting and come back after lunch, but it was only 0900 hrs. I came back after lunch and was informed again that the Brace fitter guy was not here, so I left. Then 2 days later I got the same LBP Brace that did not work for me.
Then this happened. I received my Clothing Allowance letter, stating that my clothing allowance is being reviewed, then while I was trying to get fitted, I guess it triggered Prosthetic area to act on my case. Then a days later I received my denial letter specifying that my LBP Brace is not on the list of approved devices.
The 2 part LBP Brace I was fitted for was on the approved device list.
The New LBP Brace was the standard off the shelf, was not on the approved device list.

I need help with a CUE, (and deciding if it's worth filing or if we should just contact an attorney to file a NOD). My husband filed disability for 1. Large Intestine Resection with moderate symptoms (7329) & 2. Residual painful scarring; status post left hemicolectomy. (7804). We provided to them his IN SERVICE active duty surgical records showing the emergency surgery was performed due to an intestinal bleed.
They issued their decision stating that "Service connection is denied since this condition neither occurred in nor was caused by service. There is no objective evidence to support the claimed condition of intestinal bleeding or ulceration; There are no medical records to support the veteran's claimed colon removal. Therefore it is less likely than not that the veteran's claimed colon removal was incurred in or caused by surgery while on active duty."
We responded with "new and material evidence" sending ADDITIONAL medical service records which included the emergency admit records at Bethesda, the subsequent clinical medical notes and follow up treatment records and the lab records showing their examination of the 7 1/2" of removed colon. We also sent color photographs with and without scale of the large abdominal scar and a Nexus statement from his current primary care physician stating that his current and ongoing symptoms are more likely than not a result of the prior surgical procedure.
They responded back that the claim "remains denied because the evidence submitted is not new and relevant".???!!
Will a CUE help? If so, is there a "form" we file it on or does it just get submitted on a 21-4138? What do we need to put in the CUE to explain that they're idiots and clearly did NOT look at any of the medical records if they think he did not have a GI bleed and surgery? I don't understand how/ why this can be denied when we have all the medical records showing it happened while he was on active duty?

Berta I had a very bad concussion in football high schoolin 1962 bells palsy in 1963 and rhino plasti cavus feet condition but still was drafted injuly 1967. My question is does any of this have any weight for my diagnosis of PTSD by my private psch doctor, or anything else for that matter.? thanks Dennis

I am currently waiting for a DRO review of my appeal for denial of bipolar disorder, but I have no idea if what I submitted is any good. I considered posting everything (redacted of course) to get some feedback, but there's some very personal stuff in there and I'm not entirely comfortable with that.
