  1. I been researching trying to find an answer...Im a 100 percent permanent and total and IU. I have rental property and can make around 900 a month will that cause me to lose any of my benefits and is it considered work also recieves social security disability benefits... Thank You

Just to add it was my VA Rep who suggested it, also my Sen is the Ranking Member on the Senate Commitee on Veteran Affairs if that mean anything...Thanks for the info, will discuss with the Rep if its even worth it considering the info you guys weighed in on I think 30 months is long enough with out a decision thanks
  3. field claim in May of 2010 had a completion date of Dec 2012 and was told had everything they needed to process claim claim was in prep for decision phase as of Nov 2012 checked ebenefits back in gathering evidence with a new completion date of Aug of 2013 to Feb of 2014 my Vet Rep said will be sending me paper work to contact Sen. any other advice would be appreciated
  4. Ok Berta i filed the 1151 claim along with other issues it been 24 months without a decision and used the templates here. I discovered i had been malpratice on in June of 2010 by way of a Mri..I had surgery in 1997 took 12 yrs to find this out i thought the discovery rule applied so i filed the sf 95 in may of 2012 well within the two year statue and got a denial back in June of 2012 a fast three week process...Since they denied on statue of limitation maybe i should leave alone and wait on the 1151 process Im thinking if you win a sf 95 dont it offset the 1151 claim.... I know im getting in deep water should i still persue a lawyer to argue that i had no way of knowing until the June 2010 Mri? If I previal on the 1151 claim will it retro back to 1997? or when i filled the 1151 claim? thanks
  5. I got a reply back denied under sec 2401. I informed a lawyer who i was trying to get to take the case she told me they handle these claims all the time but they dont take cases once they are denied. Do that sound crazy maybe its me..... The medical eviedence showed i had surgery on the wrong level of the spine. I didnt find out until by way of a mri 12 yrs later. I know their is a discovery rule in their somewhere..but was glad to see that this was the only reason it was denied I thought the lawyer would of jumped right on it. Im still looking for an attorney and I will get a strong IMO. My question is when i ask for a reconsideration can i let a lawyer handle that or do i have six months to request that or sixty days

  7. i called the hospital where the injury occured they said to send it to the Regional office and i read something about Washington DC, so if someone could direct me to insure i cover all areas thank you
  8. Berta do i need to summitt in on a 21-8940? ........... Thanks for the info... I already asked for it on a 21-4138 it reads as follows : please understand that my erectile dysfunction and loss of bladder control (incontinence) is claimed as Secondary conditions to my back. Im also claiming bilateral sciatica and bilateral radioculopathy secondary too my lower back.... As I m receiving Social Security Disability for my condition (lower Back). I request i be given Individual Unemployable by the Veterans Administration my award letter is attached...I would like to open a claim for depression secondary to my back condition with related symptoms. And tender Scar lower back. Evidence: 13 pg Social Security Administration Adwards letter and sent it certified with signed returned receipt they got me in the past not anymore........
  9. Thanks Berta!!!!! Yes it is related. only recieved 20 % since August of 1997 didnt have this website for research Thank the Lord for You Guys...... Awarded post operative ddd of the lumbar spine in 1997....Im on SSD for my condition.... Whats amazing the Award letter from the VA was remanded back because the surgical notes were missing from the folder in 2000...Thank the lord i got my hands on those hand written surgical notes.. Berta its some much deception from that RO its ridiculous from what i see they were doing everything they could to keep that L/5 S/1 out of the equation....I filed for an increase in 2004 was denined in 2007. read over the denial letter I thought Va is suppose to consider all medical records from the VA hospital i had Mri done there, they said i summitted records from 2002 but that wasnt of concern in this case which showed post operative changes to the L/5 S/1.....Never done research until now didnt know what spinal stenosis was DDD of the spine, spondoloysis of the spine so much more to write and why i was in so much pain.... but keep going to the VA hospital and was keeped blind.My case is currently in the development phase for 17 months now was moving fine but after i entered the information about the doctors finding of the Mri it stopped espically the L/5 S/1 info he even wrote due to previous surgery at that area loss of disc space is present Just wanted to make sure i was on the right track contacted a lawyer waiting for a replay .....   10. Thanks Berta, by the way it was such a bad experience that i did wake up during the surgery from chocking!!!!!!!! thats when they probably could of told me.......Will get right on it
  11. maybe you needu to understand i had a wife right there maybe they could of told her....Or maybe they could of told me when i was awakened at that time. Or maybe they could of wrote it in the surgical notes.... Maybe you need to understand that if you have a double laminactomy that you need to have a fusion.... So 10 years later you wouldnt have to suffer from a collapsed vertabra at two levels and by the way there wasnt anything wrong with the disk that they cut.....Could someone who has experenced a double lamanactomy comment on this please....
  12. had surgery at a va hospital for a l/4 l/5 laminactomy spine surgery got surgical notes from va of the surgery... notes said surgery performed l/4 l/5 laminactomy and the procedure performed etc....... I continuiously sought medical treatment at va hospital recently had a new Mri from an outside sourcei it states its shows a l/4 l/5 laminactomy and a l/5 and S/1 right hemilactomy has been performed....I was never told I had a double laminactomy is this va neglegence its funny......It took 10 yrs to find this out
  13. condition for post operative degenerative disc disease of lumbar spine claimant: john doe date of exam 8/11/2010 date of report 8/20/2010 my cover letter saids the date time for the exam is 02/16/2011 provider ///////// address //////////////// etc i had a c&p exam for a foot condition in aug of 2010 and thats not even on this C&p exam i posted that the exam was feburary 2011 but the date on the exam is Aug of 2010 something is very wrong

I submitted paper to have a copy of a c&p exam which i had my exam in Feb of 2011 and the examiner mentioned that i had foot drop but the thing thats funny is the copy of C&P exam that i got saids date of exam is Aug of 2011 I believe they are doing everything they can to deny my claim... And this exam mentioned nothing of footdrop and maybe the examiner didnt put it in their but it just seem suspect to me...
